Texas- Reporting Child Protective Services Issues

Reporting Child Protective Services Issues

The Health and Human Services Commission's Ombudsman Office, in conjunction with the Office of the Inspector General, has established a toll-free line for people to report complaints in response to Gov. Perry's ordered statewide investigation into the practices and procedures of Child Protective Services. If you have information or concerns about casework management or inaction when children have been exposed to abusive situations, please call:

877-787-8999

You may also fax your information to fax number: 512-491-1967.

Or e-mail your information to: contact@hhsc.state.tx.us

Please include your name, telephone number, complaint and a case number, if you have one. All information will be confidential.

Every state Attorney General or Inspector General should make it their new top priority to investigate and vigorously prosecute malicious, malfeasant, sociopathic, fraudulent CPS agents practicing under the Color of Law for their Federal Crimes (several of which are capital offenses) against America's families.

What drives a child to commit sexual abuse?

What drives a child to commit sexual abuse?
Horrific behaviour is often triggered by spiral of violence and neglect that goes back generations, says study

By Nina Lakhani

London Independent

A unique insight into why young children sexually abuse other children is to be revealed in a ground-breaking study.

The research, which has yet to be formally published, was on boys aged 10 or under who have molested siblings, classmates, or friends. It found that they are invariably born into families in which abuse, violence and neglect has become routine over several generations.

The peer-reviewed study found that the boys were unable to form healthy relationships as a result of neglectful and hostile parenting. Even before starting school, they were anxious, angry and detached; bed-wetting, nightmares, self-harm and eating problems were common.

All of the boys in the study, which is to be published in Child Abuse Review next year, started abusing after being sexually abused themselves. By the time they received specialist help they had all perpetrated serious abuse against several children. This was not childhood experimentation*: their victims were as young as six months; penetration and violence were common. FULL STORY

*I am not aware of any definition of what normal "childhood experimentation" is. I certainly don't think these "experts" know, and I think the outcome of these "studies" is pre-determined- A.K.A "Circular Reasoning". In other words, JUNK SCIENCE.

It took a while to find the study referenced, but here it is-

TRENTON, Mich. - A custody hearing was held for two of Jennifer Petkov's children. A Wayne County Probate Court judge ruled on an emergency order. Her eight-year-old daughter and five-year-old son from a previous relationship will now move in with their father until further notice.

Petkov made headlines a few days ago after she admitted to taunting the family of 7-year-old Kathleen Edward, who is dying from Huntington's Disease. She posted disturbing photos of Kathleen of Facebook, and her husband Scott Petkov parked a coffin on the street in front of the girl's home.

The father of Petkov's children filed for the emergency hearing right after the story broke.  FULL STORY

Facts, not furor

Facts, not furor
Evidence, not emotion, must dictate how L.A. County handles the most vulnerable children under its care.

October 22, 2010
By Mark Ridley-Thomas and Michael D. Antonovich
Los Angles Times

Few tragedies compare to the death of a child, and in Los Angeles County, too many children die at the hands of parents or caregivers.

But in Los Angeles there is an additional disgrace: the fueling of panic over child fatalities by government officials and the news media, who continue to operate in an environment clouded by incomplete and misunderstood facts.

Are child deaths related to the Department of Children and Family Services rising precipitously? What data do we have, and what is the context? What does the data really show about the policies of the DCFS? Answers to these questions are getting lost in the furor surrounding reports of child deaths in the news media and at Board of Supervisors meetings.

News reports and officials have done little so far to put the current level of fatalities in perspective. As we see it, these are some of the fundamental sources of confusion:

The term "child death" can mean too many things.

Last year, according to the DCFS, 55 children who had department case histories were homicide victims. That fact alone evokes for many an image of an infant or toddler killed in an abusive home, when the DCFS should have spotted danger.

But "children" includes those up to 18 years old. A closer look at the 55 homicides shows that 35 were of teenagers shot or stabbed to death in assaults, many in gang-related incidents. Three youths were shot by police officers.

The label "DCFS history" applies to any child who has been the subject of an abuse complaint; the history remains with the child even if the complaint was found to be false. These children in most cases were not young children, and few were still under the care of the DCFS.

The number of children killed by parents, foster parents or relatives acting as guardians have been effectively constant since the 1990s. These figures have been overlooked.

In 1998, 20 children with DCFS histories were killed by parents, foster parents or relatives acting as guardians. In 2008, there were 14 such fatalities. The number varied from 11 to 20 in the years between. These figures are published in a widely circulated report by the county's Inter-Agency Council on Abuse and Neglect Child Death Review team, but have been forgotten amid the frenzy surrounding the DCFS.  FULL STORY

Facing deportation, mom wants baby back

Facing deportation, mom wants baby back

Canada- A mom of two who is facing deportation to Jamaica is fighting to get back her daughter who was taken from her by child welfare workers just two days after her birth at a Burlington hospital.

“I am totally heartbroken and devastated,” the 30-year-old sobbed from jail.

“I wasn’t even allowed to hold my daughter for one last time before they took me away.”

The baby was seized at Joseph Brant Memorial Hospital by the Halton CAS in March over concerns about her safety since the mom had no status in Canada.

The mom was allowed to visit the tot for an hour monthly at a CAS office in Niagara Falls and was arrested there Oct. 7 on an outstanding warrant as she was about to see her daughter.

She also has a four-year-old son who is being looked after by relatives. The mom suspects a former boyfriend tipped off immigration authorities.

She is being held at a Rexdale Blvd. detention centre and will appear in a Milton family court Thursday to try and get custody of her daughter. She is scheduled to be sent back to Jamaica the next day.

“I have only seen my daughter a couple of times,” she said. “This is an injustice that has been done to me.”

She didn’t expect immigration officials to be called after checking into the hospital.

“I told the officials at the hospital that I had no immigration papers and I didn’t think they would contact the authorities,” she said from detention. “I haven’t seen my baby in more than a month.”

She arrived in Canada in 2001 as a visitor and overstayed her visa.

“I want my baby back,”
she said. “I want to take her home with me.”

Immigration consultant Roy Kellogg said even if the mom is granted custody Thursday she would require travel documents to take the child, who is Canadian, to Jamaica.

“This child can become a ward of the state if she remained in Canada,” Kellogg said. “There is no way she can obtain a passport in time to return to Jamaica with her mother.”

The child was taken after workers at the hospital learned the mom was in Canada illegally and began investigating, he said.

“There was a concern that the child may not have a safe environment,” Kellogg said. “She even has an aunt willing to sign a bond and look after the child.“

Hospital spokesman Julie DePaul said she couldn’t comment on the case citing privacy laws.

Halton CAS also refused comment.

"Typhoon of official neglect" ... child abuse
reports doubled after the intervention.
Australia- KON VATSKALIS, the Northern Territory's Minister for Children and Families, admits he will have to tear down the system for protecting Aboriginal children from abuse and neglect and start again.

"The department has been demoralised … we are now going to rebuild from scratch and we have to leave the old ideologies [of child protection] at the door," he said.

His was a startling admission of failure. In the three years since the biggest federal intervention in 50 years of government in the territory, agencies are struggling to come to terms with endemic mistreatment of children.

Widespread sexual and physical abuse of indigenous children was identified three years ago by the Howard government. This week, in the wake of another government report, it was labelled a typhoon of official neglect.

Vatskalis and the territory's Chief Minister, Paul Henderson, offer few excuses. They admit to being overwhelmed by the scale of abuse and neglect and shocked by the findings of bureaucratic bungling. They promise action. Full Story

California foster care bill treats the wrong wound

Opinion: California foster care bill treats the wrong wound
By Richard Wexler

There's been a lot of unctuous self-congratulation in California's child welfare establishment over a new law that purports to solve the problems of foster care by adding three more years of foster care. The bill may do a little bit of good around the edges. But mostly, it's just a bigger Band-Aid for the wrong wound...

No, Kids, The 911 Operator Is Not There To Settle Beefs With Daddy

No, Kids, The 911 Operator Is Not There To Settle Beefs With Daddy
The Smoking Gun

Despite reports that a 10-year-old Illinois boy called 911 last week and complained about the dinner his father served, police tapes show that the child actually dialed the emergency number and hung up without speaking.

When the operator called the number back, the boy’s father, Stefan Cristoltean, answered the phone and explained that his son had been misbehaving. “I told him to call 911. He’s misbehaving in front of me and I told him, ‘Call them, let them come over here and see who’s right.’” And the child did just that.

Click here to listen to excerpts from the October 14 dispatch tape.

At one point on the tape, the 41-year-old Cristoltean told the operator, “Now he’s begging me to tell you not to come over here.” In the background, the boy can be heard wailing, “Don’t come over. Noooo.”

Cristoltean calmly explained, “I said, ‘You know what? Call 911 if you think that you have a disagreement with me and you’re right.’ And he called 911.” While beckoning the boy to return to the dinner table from his bedroom, Cristoltean told the operator, “He thinks that is just a joke this 911. I’m telling him that is not a joke and we have to impose some rules in the house and the have to follow the rules.”

When a Buffalo Grove Police Department officer was dispatched to the Cristoltean residence, the child noted that his dinner, “was edible but that he wanted something more to his liking,” according to a police statement. Before departing, the cop advised on the proper use of the 911 system.

Child abuse case acquitted

Texas- A 12th Judicial District Judge handed down a directed verdict in the Paul Henley abuse of a child trail Monday.

Henley was on trial for one count of third-degree felony intentional abuse of a child or cruel punishment.

Judge Jerry H. Ritter Jr. gave the directed verdict of acquittal on the basis the prosecution had not proved its case after the state rested its case on Monday. Ritter granted the directed verdict on what he felt was a lack of evidence and mens rea or guilty mind.

Mens rea is defined as a mental state accompanying a forbidden act to be illegal. The act must be illegal and accompanied by an intention to commit a crime. FULL STORY

I left a comment there-

Wow. A sane judge. How refreshing. And a hearing in a real court that demands real evidence is unheard-of in most states. This is what is known as "Due Process".

See "What Happens in the Fog", an essay about CPS cases in most states-
http://familyrights.us/educate/what_happens_in_the_fog.html

In most states, the standard CPS mode of operation is to kidnap the kids, unconstitutionally Legally Abuse the parents for Imaginary Crimes, dope the kids out of their heads in state custody, fraudulently collect their Medicare, and put them up for sale in the Kiddie Pound.

There is absolutely nothing honorable or good in this agency. They have NO success stories. They destroy every life they touch.

Be ready to answer the CPS agent when she brings the False Allegation to YOUR front door.
