How to Write a Declaration of Facts to Submit to the Court

How to Write a Declaration of Facts to Submit to the Court

When parents appear in Juvenile Court they are handed a report written by a CPS social worker. It states the county’s side of the court case.

Who writes a similar report explaining the parents’ side of the case to the judge?

Usually, nobody.

Legal documents explaining the parents’ side aren’t written because they have court-appointed attorneys that in general, often don’t care enough to take the time to produce legal documents. Many of these attorneys receive a flat fee per case so there’s no financial motivation for providing an aggressive defense for the parents.

Most often, court appointed attorneys in Juvenile Court simply guide the parents through the hearings and advise them to sign a plea or stipulation of some kind, which implicates them as being guilty. If the parents sign (most do because their court-appointed attorneys are advising it) there will be no trial – no opportunity for them to protest their innocence or defend themselves. Without a trial there’s never going to be a time when the CPS social worker has to prove the county’s case.

So what should CPS victim-parents do to counteract the problem of having a court-appointed attorney who won’t aggressively defend them?  FULL STORY

PATERSON, New Jersey - Muslim community leaders Tuesday demanded an investigation of a caseworker for the state's Division of Youth and Family Services who they say insulted Muslims when he allegedly hurled racial and religious slurs at them at a local restaurant.

Sandra Damrah and Mohamed Metwaly Khalil of Woodland Park filed complaints with DYFS and Paterson Municipal Court against the caseworker, whom they identified as Ezeadi Kelechi, after a Nov. 23 incident at Uncle Lou's Restaurant in Paterson.

The caseworker saw Khalil and Damrah at a table and allegedly shouted, "Terrorist!" and asked, "Do you have your bomb belt?" and "Are you going to slit my throat?" recalled Khalil, an artist who works as assistant curator at the Paterson Museum. Khalil added that the man was accompanied by a DYFS colleague, who did nothing to halt the abuse.

Khalil identified Kelechi as a caseworker who had handled his attempt to regain custody of his son, who is in the DYFS foster care system and separated from his father for a year.

CLEVELAND — Two social workers involved with a case of alleged child abuse have been placed on administrative leave.

An internal review was launched by the Department of Children & Family Services Monday after a 46-year-old Cleveland woman was arrested for child endangerment and domestic violence.

In a statement released Monday, DCFS said:

"The Department of Children & Family Services conducted an internal review of all contacts with the children and families involved. Director Forkas placed two staff on administrative leave; further internal investigation is ongoing."

Renee Lester is accused of keeping her four adoptive children locked in a dark room with little to eat. She was arrested Friday at her Edgewater Drive home and taken to the Cleveland City Jail.

Cleveland police said the prosecutor's office is not filing charges against Lester at this time. She was released from jail Monday evening pending further investigation, officials said.

Lester's four adoptive children, along with three of her other children, are now in the custody of Children and Family Services.

All seven children will be placed with a foster family today, the statement said.

Additional details were not released.

UTICA, N.Y. (AP) - A case worker responsible for investigating child abuse cases has been charged by federal authorities with receiving child pornography over the Internet.

Stanley Dorozynski, who also is a former Utica police officer, appeared in federal court Tuesday on child pornography charges.

He remains in the custody of U.S. Marshals pending a hearing on Thursday. Oneida County Social Services Commissioner Lucille Soldato said Tuesday she was aware of the charges against Dorozynski, but declined to comment further.

Sgt. Steve Hauck of Utica Police says  Dorozynski was a Utica police officer from July 1980 to July 2000. He has been a child protective services case worker since 2008.

Child Molesters: A Behavioral Analysis

"Adults with an added authority (e.g., teachers, camp counselors, coaches, religious leaders, law-enforcement officers, doctors, judges [DA and child protection attorneys]) present even greater problems in the investigation of these cases. Such offenders are in a better position to seduce and manipulate victims and escape responsibility.
...The most difficult case of all involves a subject who has an ideal occupation for any child molester: a therapist who specializes in treating troubled children. This offender need only sit in his office while society preselects the most vulnerable victims and brings them to him. The victims are by definition “troubled” and unlikely to be believed if they do make an allegation

So is there little doubt that a pervert CPS guy wouldn't be taking advantage of helpless VULNERABLE young mothers?

NORWALK, Connecticut -- A city man under investigation by the state Department of Children and Families was arrested Monday after he allegedly threatened to punch a female DCF worker in the mouth at a meeting at his children's school.

Jerome Singletary, 57, of 306 Flax Hill Road, was charged with second-degree threatening and second-degree breach of peace and released on a promise to appear at court.

Lt. Timothy Murphy said Singletary threatened to punch the female investigator's teeth down her throatFULL STORY

We all have wanted to do that, but Singletary fell for the trap. CPS agent are deliberately snotty and over-bearing skanks who WANT you to get mad and say something. There is no such thing as a CPS "investigator". They are VALIDATORS. They aren't looking for the truth. They believe any allegation, and they are going to make it stick to you. See how it works?  Be prepared for when CPS brings the false allegation to YOUR FRONT DOOR

Good news for Maria, twins

It is sad, but enough Texas girls in foster care have babies that the state has an official policy as to their rights.

On the Texas Department of Family and Protective Services, Right No. 33 is "To not get pressured to get an abortion, give up my child for adoption, or to parent my child, if applicable."

Right No. 34: "To hire independent mental health professionals, medical professionals, and attorneys at my own expense."

The 14-year-old girl I called "Maria" in Sunday's column wanted her own attorney. Juvenile Judge Pat Shelton has set next Monday as the trial date for a Child Protective Services suit to take away her parental rights to twin boys she gave birth to in August.

That is an extremely short time for a process that usually, I'm told, takes a year or more.  FULL STORY

Results vary in Pa. child-welfare worker survey

Results vary in Pa. child-welfare worker survey

HARRISBURG, Pa.—A national social workers' advocacy group says 84 percent of Pennsylvania's child-welfare caseworkers have a bachelor's degree in human services, but it says seven counties rate well below the average.

The Pennsylvania chapter of the National Association of Social Workers released the report Monday.

It says it gathered the information on every child-welfare caseworker in Pennsylvania, a process that took 11 months and required requests under the state Right to Know Law.

It found eight counties with 100 percent of caseworkers who have a bachelor's degree in human services: Butler, Carbon, Forest, Huntingdon, Lackawanna, Lebanon, Montour and Sullivan.

But it says seven counties are below 70 percent: Blair, Cameron, Elk, Greene, Mifflin, Somerset and Wayne.

It says Pennsylvania's requirement for caseworkers is 12 college credits in social sciences.

Seriously, how many people know how useless a bachelor degree is?  Two years.  Social sciences.  The kids in college taking social science and psych courses are the stupidest kids on campus.  Absolutely vapid.  Absolutely communists.  Nasty, low IQ people with loser personalities.  The worst of the worst.

At the height of her campaigning for President Obama's plan to nationalize health-care decision-making, outgoing House Speaker Nancy Pelosi famously quipped, "Are you serious? Are you serious?" when asked about its constitutionality.

But that question won't need to be asked in the coming Congress, where Republicans will hold the majority in the House, because of a rule being proposed by Speaker-designate John Boehner and other Republicans that would require those proposing legislation to cite the constitutional authority for the plan.

"The Pledge to America released by House Republicans in September of this year included a commitment to 'require every bill to cite its specific constitutional authority.' FULL STORY

Ex-DSHS employee sentenced in theft of $156,000 in phony child care claims

A former financial tech with the Washington State Department of Social and Health Services was sentenced Friday in U.S. District Court in Seattle to 15 months in prison and ordered to pay $156,728.71 in restitution.

Janice Mann-Wilson conspired to steal government funds and misused social security numbers, according to a press release from the U.S. Attorney's Office in Seattle.

The report said the 33-year-old Kent woman collaborated with others to submit false information to DSHS to get thousands of dollars in payments for child care services that were never provided.

According to records, she worked as a financial services specialist at the Ballard Community Service office of DSHS from 2006 until she was fired in January 2008.

In May 2007, she started to embezzle federal funds from the "Working Connections Child Care Program." She trained a co-worker in the scheme, and recruited her friends and relatives, according to the release.

She would enter false information into the database in order to get the checks for child care. In some instances, she used the social security numbers of children living out of state, or used fake social security numbers or created fictitious children.

She had many of the checks mailed to her sister’s home and then distributed them to the co-conspirators. They would give her a share of the money. Sometimes, they claimed the child was receiving “special needs’ care to increase the payment rate. One conspirator was paid nearly $49,000 for care to non-existent children.

The scheme unraveled when an anonymous letter was sent to DSHS after a disagreement between the co-conspirators.
*

In asking for a significant sentence, Special Assistant U.S. Attorney Johanna Vanderlee noted that Mann-Wilson was the ringleader of the conspiracy. "The public has a stake in knowing that government employees are not abusing their positions of trust and in knowing that public benefits intended for low-income, working families, are properly used. Defendant recruited relatives, friends, and a colleague into her lucrative conspiracy," the prosecutor wrote in her sentencing memo.

* Note- They didn't actually get caught.  Which should say something about the agencies, I would think.  Actually, I think the agencies are conducting the same identical fraud.

Study: Kids All Hopped Up On Caffeine

Study: Kids All Hopped Up On Caffeine

The Gothamist

Remember when you were a kid and you'd beg your parents to let you order a Coke at a restaurant but they told you you were too young to have caffeine and you spent the rest of the meal plotting the phone call you were going to place to child protective services when you got home?
* Apparently that was just us, because according to a new study [pdf], 75% of kids between the ages of 5 and 12 consume caffeine on a daily basis. Though it's based on a relatively small survey of 201 kids, Dr. William Warzak says, "Some children as young as 5 years old were consuming the equivalent of a can of soda a day." Let's just start the total caffeine ban countdown now.

Aside from having 5-year-olds running around like speed freaks, the study says that the more caffeine the children consumed, the less they slept. Dr. Warzak told the Daily News, "Caffeine is not some boogie man, but at some point for all of us, too much caffeine is a problem." Doctors also said more research needed to be done on whether or not caffeine can stunt a child's development. Meanwhile, we're on our third cup of coffee of the day. But we can quit whenever we want.

I fought it long and hard.  There still isn't enough people in this country whose families have been hurt by CPS to take interest.

The Bully Pulpit- sound like any CPS people you know?

The Bully Pulpit

I'm a goddam bully and I like it. Gimme a patsy to push around and I'm busier than a one-armed man with a paddle at an ass-whooping convention. I believe in punishment, not because there are people who deserve to be punished, but because I like punishing people. Makes me feel good. Doesn't matter what they did, it serves them right. Vanquishing a foe gets me much harder than beating them in a pansy argument. Physical power trumps brain power every time. Might doesn't make right? Right or wrong makes no difference to me as long as I get to exert my power, because it's all about me and my ability to push people around. Whatever makes me feel good, and today, nothing would please me more than exercising a bit of discipline. Not on my self, of course. On others.

You saw me in the schoolyard and you tried to stay out of my way but it didn't work. I stopped you on the way home and broke all your pencils. Tough shit. Run away crying. You fail to realize that the only thing of importance in this universe is my getting my way. Bow down before me, you sniveling toad, and watch what it's like to be me. Don't get in my way. Do what I say or get hurt, even if what I say has no meaning, even to me. ESPECIALLY if it has no meaning to me. Do you think I NEED your tongue on my shoe? Tongues are a dime a dozen. What I need is proof that you will do what I say. Read that sentence again.

Now that I've grown up a bit, I've put aside the childish pleasure of washing blood off my knuckles. These days, I'd rather sit at a distance and let others do my chastising for me. I like to watch. Let 'em suffer. Suffering's good. Make someone suffer in the morning and it puts a spring in your step the rest of the day.

The stronger I get, the better for everyone who does what I say. The more people who do what I say, the stronger I get. Other than personally pummeling some nobody, nothing gets me off more than telling someone to do something completely outrageous and watching them go off to do it, regardless of how petty or vicious or degrading the task. Hey, watch this. You! Over here! Kiss my ass! See? Pretty cool, huh?

I've built special rooms where people do terrible things to other people and I get to see it on TV. I ask them questions I know they don't know the answer to just so I can watch them beg for mercy. Ha! Mercy's for suckers and begging is SO yesterday. Why should I show mercy when the whole point is to watch them suffer? If nobody suffers, what's the point? I'm a one-man study group in the fine science of suffering, pushing the envelope to new extremes, boldly making others suffer in brand new ways nobody ever thought of before, and I don't have to go begging for grants to continue the investigation. I got your grant right here.

People who have only known pain in their lives aren't good sufferers. They don't know any better. Give someone a taste of the good life, THEN come down on them, and see what suffering's all about. They know what they're missing. They know how nice things can be, making them squirm even more delightfully when the shit comes down. The suffering of one dilettante is worth ten times the suffering of hordes of foreign rabble but hey, you take what you can get.

Truth is what I say it is. The whole world is a plaything for my amusement, and my way of playing with toys is to break them. I'm only happy when I'm in charge. Nothing pisses me off more than someone disagreeing with me. I don't listen, I talk. I'm through with arguing. No more arguing for me. Who needs it? Not me. Totally pointless. Never achieves anything, and I'm an achiever. Achievers don't say please, they say "Do what I say or I'll grind you to a pulp." Achievers rule the world. When's the last time a non-achiever took control?

Look at you, you germ, you maggot, you pseudo-intellectual. What do you think you're doing? Who said you could read this? Put it down right now. You heard me, stop reading immediately and look at me. What's the matter with you? Why aren't you doing what I say? Now I'm getting mad. Real mad. Wait till you see what happens to you when you stop reading. Now you're going to get it.

Sure sounds like a CPS agent to me
