The county doesn't have California's highest rate of new foster-care entries, but it's a contender. Shasta ranks fifth in the state, while a band of rural northern counties — Plumas, Butte, Siskiyou and Del Norte — tops the dubious list.

Hello,

My cousin was recently killed in an Oregon foster care home. I have had children in foster care and seen homes that are barely better than the homes they were removed from and homes that try to serve both emotional and physical needs of children, as best they can. DHS--child welfare, does not seem to be hearing the voice of the children, who are telling officials, when they run away, etc, that these homes are not always appropriate. With that said, I am assembling Real Stories of Foster Care. I am looking for stories of foster care, both positive and negative, from all perspectives. Parents/grandparents your stories are great, most importantly I want the child's story. If they can write it themselves, or if it needs to be written by an adult---I want them all, please. I really am interested in Oregon stories, but would enjoy hearing from other states, also.

DAVOS, Switzerland -- A former WikiLeaks spokesman launched a rival website Friday, saying he planned to give whistleblowers more control over the secrets they spill.

The new platform, called OpenLeaks, will allow sources to choose specifically who they want to submit documents to anonymously, such as to a particular news outlet, said Daniel Domscheit-Berg.

Utah Auditor General Releases Foster Care, Child Welfare Audit

An audit of the Utah child welfare and foster care systems was released on January 18, 2011, by the Utah Auditor General. While it is hardly what I might consider as a “scathing” audit, it is refreshing in its candor.

The report explains that: “Over the past decade, the number of children DCFS serves in foster care has increased by 38 percent, while the number of families receiving in-home services that allow children to remain home has decreased by 40 percent.” The auditors continue on to note:

DCFS’ focus on providing foster care services rather than in-home services is problematic for the following reasons:
  • Research shows that children are best served and permanency outcomes are enhanced when children can safely remain at home with their families.

  • Foster care is much more expensive than in-home services and the average duration of foster care cases is nearly four times longer than in-home cases.

Lincoln Sen. Kathy Campbell closed a Friday hearing on a child welfare reform resolution by clarifying what it was not intended to do.

The proposal to allow the Legislature's Health and Human Services Committee, which she chairs, to investigate and assess the state's child welfare reform was not meant to return to former ways of operating the system.

And it was not an attempt to micromanage the Department of Health and Human Services.

TV show leads to charge against Alaska woman

ANCHORAGE, Alaska – An Anchorage woman is charged with child abuse because of a "Dr.Phil" TV show appearance in which the audience saw video of her disciplining a 7-year-old son by putting hot sauce in his mouth and forcing him into a cold shower.

The methods chosen by Jessica Beagley were unreasonable, said municipal prosecutor Cynthia Franklin.

The lawyer for the 36-year-old mother said the city is intruding into a family matter.

"She has not done anything that would warrant a criminal charge for child abuse," said attorney William Ingaldson. "If this hadn't showed up on `Dr. Phil,' there wouldn't be anybody saying anything about it."

Beagley is pleading not guilty at Friday's arraignment, he said.

"Some people think spanking your child is wrong, and she doesn't even do that," Ingaldson said.

Neither the child in the video nor five other children in the home have been removed by the Office of Children's Services, the Anchorage Daily News reported Friday.

Beagley's husband, Gary Beagley, is an Anchorage police officer. He's not under investigation, said the department spokesman, Lt. Dave Parker.

"Ultimately, a jury will have to decide if that's the case," Parker said.

In the video, Beagley is punishing the boy for "pulling three cards," a reference to three reports from his school of bad behavior.

"We've tried timeouts with (him)," Beagley says in a YouTube video from the "Dr. Phil" appearance. "That is a big joke."

In the video, Beagley goes on to explain that those previous methods of discipline — timeouts, spankings, forced exercise, soap in the mouth — didn't stop the boy from acting out and lying, so she turned to hot sauce.

When she's at her wits' end, the boy gets a cold shower, Beagley says.

Municipal law on child abuse lists several factors in determining what is reasonable parental discipline. One example of unreasonable discipline included in the code is the scalding, branding or burning of a child.

Though the code does not mention hot sauce specifically, the section on burning applies to hot sauce, according to the prosecutor's office.

The Beagley children haven't had physical injuries or medical care for injuries, the defense lawyer said.

The case has attracted the attention of Russian media because the boy and his twin brother were adopted from Russia when they were 5 years old, said Franklin, the prosecutor.

Parents who knowingly put a child in harm's way would be guilty of a misdemeanor under legislation currently before the West Virginia Senate.

The Senate heard its first reading Wednesday of Senate Bill 71, which amends existing child neglect code. Under the measure, parents or guardians who neglect a child, "and by the neglect create a substantial risk of bodily injury," would be guilty of a misdemeanor. FULL STORY

Newspapers sue to get Ky. child abuse records

LOUISVILLE - The state's two largest newspapers have filed a lawsuit against the Cabinet for Health and Family Services, alleging officials are refusing to release records of some child abuse deaths and injuries even after a judge ruled last year that such documents must be released under the state open records law.

"The cabinet has deliberately evaded the court's ruling and has continued to intentionally violate the Open Records Act by refusing to disclose its records relating to cases where child abuse or neglect has resulted in fatalities or near-fatalities," said the lawsuit filed Thursday in Franklin Circuit Court by The Courier-Journal and the Lexington Herald-Leader. Eavesdropping Laws Mean That Turning On an Audio Recorder Could Send You to Prison

Christopher Drew is a 60-year-old artist and teacher who wears a gray ponytail and lives on the North Side. Tiawanda Moore, 20, a former stripper, lives on the South Side and dreams of going back to school and starting a new life.

Christopher Drew faces eavesdropping charges for recording his arrest for selling art on the streets without a permit.

About the only thing these strangers have in common is the prospect that by spring, they could each be sent to prison for up to 15 years.

“That’s one step below attempted murder,” Mr. Drew said of their potential sentences.

The crime they are accused of is eavesdropping.

The authorities say that Mr. Drew and Ms. Moore audio-recorded their separate nonviolent encounters with Chicago police officers without the officers’ permission, a Class 1 felony in Illinois, which, along with Massachusetts and Oregon, has one of the country’s toughest, if rarely prosecuted, eavesdropping laws.

“Before they arrested me for it,” Ms. Moore said, “I didn’t even know there was a law about eavesdropping. I wasn’t trying to sue anybody. I just wanted somebody to know what had happened to me.”

Ms. Moore, whose trial is scheduled for Feb. 7 in Cook County Criminal Court, is accused of using her Blackberry to record two Internal Affairs investigators who spoke to her inside Police Headquarters while she filed a sexual harassment complaint last August against another police officer. Mr. Drew was charged with using a digital recorder to capture his Dec. 2, 2009, arrest for selling art without a permit on North State Street in the Loop. Mr. Drew said his trial date was April 4.

Both cases illustrate the increasingly busy and confusing intersection of technology and the law, public space and private.

“Our society is going through a technological transformation,” said Adam Schwartz, a lawyer with the American Civil Liberties Union of Illinois, which last August challenged the Illinois Eavesdropping Act in federal court. “We are at a time where tens of millions of Americans carry around a telephone or other device in their pocket that has an audio-video capacity. Ten years ago, Americans weren’t walking around with all these devices.”

OKLAHOMA CITY -- New developments in the case of an Oklahoma City police officer accused of molesting his foster son.

Oklahoma City Police Sergeant Maurice Martinez was arrested last week following allegations of sexual misconduct involving his 16-year-old foster son.

Now the teen's biological family said the whole thing is a big misunderstanding, and they showed News 9 a videotaped confession from the alleged victim, saying he made the whole thing up.

"It's all a lie," said the boy on the tape, who according to family members is the 16-year-old accuser. "All these statements I've been saying, it's all stupid. We got into a fight and I just wanted to get back at him."

Martinez's family said the DVD was given to them anonymously. It appears it was taped inside the teen shelter where the boy is now staying.

"I just want to retract every statement and make everything alright," the teen continued. "I deeply apologize for everything I said."

The 16-year-old's brother, Jordan Martinez, told News 9 the boy on the tape is indeed his brother and he believes he's telling the truth.

Jordan Martinez also said he never doubted the story was made up. He contends a member of his church blew a sarcastic comment out of proportion.

The 16-year-old said the case got out of hand after that comment was taken out of context.

SACRAMENTO — Family courts in Marin and Sacramento counties can't prove that many of the professionals they hire to sort out emotionally charged custody cases have the required training and experience to do their jobs, according to a state auditor's report released Thursday.

In Sacramento, seven of 20 court-employed mediators and evaluators couldn't show the auditor's staff that they had met qualification and training standards set by state law and the California Rules of Court, the report found. The same was true for seven mediators in Marin County Superior Court, according to the auditor.

That lack of documentation means court leaders can't evaluate whether family court professionals have the skills "to guide the parties through mediation effectively or to assess properly a family's condition and ensure that the outcome is in the best interests of the children," the auditor concluded.  FULL STORY

Five Charged with Abuse of Developmentally Disabled Child in Palatka

PALATKA, Fla. -- Five people face charges following what police said was the abuse of a developmentally disabled juvenile, but two of them remain at large.

According to the Palatka Police Department, the investigation began Jan. 3 at a facility in Palatka following a report of a burned juvenile.

The burns reportedly were made with a clothes iron.

After the investigation, detectives determined that 21-year-old Kavarus Bellamy, an employee at the facility, had apparently intentionally burned the victim while fellow employee Jolissa Battles, 20, sprayed a chemical in her face as former employee Devin Wesley, 21, held her down.

Detectives also believe 31-year-old Yolanda Miller and 26-year-old Jamon Davis were in the facility and knew what was happening, but did nothing. They each face charges of failure to protect a child and failure to report child abuse. FULL STORY

Big Victories, Bigger to Come

In the last two weeks, we have met two important goals in our efforts to promote the Parental Rights Amendment, each pointing to even bigger things to come.

First goal: a resolution in each of 40 states to encourage Congress to propose the Parental Rights Amendment. As of today, efforts are underway in 44 states (remember, Louisiana and South Dakota already passed resolutions in 2010). In the days ahead we will see many of these resolutions receive bill numbers, come out of committee, go to the floor for a vote, and eventually get adopted. Every resolution passed is big news for us, and as we pass 10, 20, 30…. Well, the news just gets bigger!

Second goal: 1000 screenings of “The Child.” We reached that number last Friday! Based on responses from volunteers across the country, we know screenings beget other screenings as people watching the film understand the urgency to pass this message along. Now that 1000 screenings have been scheduled, we have confidence in the prospect of reaching 2000, 3000, and so on. Schedule yours now at parentalrights.org/thechild

Now, what we have not done in the last two weeks is launch a call blitz. With the new Congress, new leadership and a new agenda, plus the fact that everyone is taking the Parental Rights Amendment very seriously in this Congress, things on Capitol Hill are taking longer than expected. While we never like delays, the fact is these are exciting developments indicative of the stature to which the PRA has grown in a very short time. So, I thank you for your patience, and I will let you know about that call blitz when things are ready, whenever that may be.

In the meantime, here are a few things we need you to do:

Secure petition signers. Send them to parentalrights.org/petition, and have them be sure to enter their state so they can count toward both the federal Amendment and your state’s resolution.

Florida- Broward County child welfare officials failed to protect an infant who suffered brain damage after he was allowed to continue living with his mother and her boyfriend despite signs of abuse, one of the child's attorneys told jurors Monday.

Two months before Jace Manning's skull was fractured, his grandmother warned authorities that the 5-month-old was in danger after he was hospitalized with an unexplained bruise under his chin, said Gary M. Cohen, part of the legal team suing the Broward Sheriff's Office and Broward County on Jace's behalf. Opening statements in the Broward Circuit Court case were Monday.

"This never should have happened," Cohen said. "They had two months to get it right."

An attorney for the Sheriff's Office countered that the child protection investigator assigned to Jace's case did her job, trying to do what was right while following the law. The investigator was only "one spoke in the wheel" of the child protection system, said Sheri Weissenborn, part of the sheriff's legal team in the case. FULL STORY

Oregon- A state manager loses his or her job after doing something really rotten in the workplace — sexual harassment, say, or gross financial mismanagement.

But months later the villain is back working for the state, only in a new job at a new agency.

The public never finds out.

This practice occurs so often that some state workers have assigned it a nickname. They call it "passing the trash."

Attorney General John Kroger says he's never heard that term, but he knows of the practice and he wants it to end.

And he just might succeed if the Oregon Legislature enacts the Government Transparency Initiative that Kroger has put before the body.

Among other things, the initiative would eliminate more than 100 exemptions to Oregon's public-records law. These exemptions often used by officials to prevent the release of important public documents.

One such exemption seals the disciplinary records of all public employees. FULL STORY

Whistleblower suit headed for trial

LEXINGTON, Ky. — More than three years after a former Lexington-area social worker filed a whistleblower action against the state, alleging misconduct by her bosses in child abuse and neglect investigations, her case appears headed for trial.

But Jami Hall’s lawsuit against the Cabinet for Health and Family Services has had some odd twists — including sensitive files that “curiously disappeared,” and a last-minute decision by one her former supervisors to apologize to Hall and testify on her behalf at the trial.

Cabinet lawyers were caught off guard when Arthur Hayden, a former top supervisor in the Lexington social service region who oversaw Hall’s office, announced in October — one week before the suit originally was to go to trial — that he would verify some of Hall’s claims in the suit.

....Hall began work for the cabinet as a social worker in 2002 and moved to its Jessamine County office in 2004.

She resigned in 2008, the year after she filed her whistleblower suit, alleging that cabinet officials ignored her reports of wrongdoing in child abuse and neglect cases by Melanie Taylor, her immediate supervisor, and then retaliated against her.

In the suit, Hall alleges that Taylor backdated reports of suspected child abuse and neglect to make it appear social workers responded promptly, refused to take some reports of abuse and once decided to leave children in an unsafe home “to limit paperwork.”

A Polish research institute has developed a board game to teach young people about life under Communism. In the game, which is inspired by Monopoly, players must wait in endless lines at stores for scarce goods. For added realism, they have to put up with people cutting in line and products running out -- unless they have a "colleague in the government" card.


There are no glamorous avenues for sale, nor can players erect hotels, charge rent or make pots of money. In fact, a new Polish board game inspired by the classic Monopoly is all about communism rather than capitalism.

The goal of the game, which will officially be launched on Feb. 5, is to show how hard and frustrating it was for an average person to simply do their shopping under the Communist regime in Poland. The game has been developed by the Institute of National Remembrance (IPN), a Warsaw-based research institute that commemorates the suffering of the Polish people during the Nazi and Communist eras.

Just like in the original Monopoly, acquisition is the name of the game. In this case, however, that means struggling to get basic necessities such as food, clothing and furniture. "In the game, you send your family out to get items on a shopping list and they find that the five shops are sold out or that there hasn't been a delivery that day," the IPN's Karol Madaj told SPIEGEL ONLINE Thursday, explaining that the game "highlights the tough realities of life under Communism."  FULL STORY

Another case of abuse of a boy, adopted from Russia, is being investigated in the United States.

At the moment the 7-year old Daniil Bukharov from Magadan is still in his foster family.

The story drew the headlines when a certain Jessica Bigley from Anchorage, Alaska, took part in a popular TV show in November last year.

She elaborated on her methods of upbringing the recalcitrant child, such as mouth washing by a hot pepper sauce or placing the boy under cold shower.

Tens of thousands of people watched the show.

But it has only just transpired that the boy is from Russia and that he lives in a foster family.

OKLAHOMA CITY – A woman who threw herself at the mercy of the court after being accused of abusing her son has been sentenced to two life terms for child abuse.

Oklahoma County District Judge Lisa Davis imposed the sentence Thursday on LaRhonda Marie McCall. McCall's friend Steve V. Hamilton was sentenced to life plus 20 years.

Prosecutors said the boy was choked, starved, stabbed, tied up and set afire, and that he was once covered with a sugar-water solution and left outside so bugs would bite him. He never went to school.

McCall pleaded guilty last year but did not have a plea agreement, opting instead to let the judge set a penalty. Hamilton entered a similar plea.  FULL STORY

A 16-year-old boy told people at his church he was being sexually abused by an Oklahoma City police officer before it was reported to authorities, according to a probable cause affidavit.

A 16-year-old boy told three people at his church he was being sexually abused by an Oklahoma City police officer, according to a probable cause affidavit.

Sgt. Maurice Anthony Martinez, 44, was arrested Wednesday on complaints of forcible sodomy and lewd acts with a child under 16 and placed on paid administrative leave from his job as a patrol officer. He has not been charged.

The teen told a police detective he had been made to perform sex acts several times since his 14th birthday, according to the affidavit filed Thursday. He also told police he knew of other victims.

Martinez has had about 60 foster children come through his home since 2001, a Department of Human Services spokeswoman said Thursday. At the time of his arrest he had three foster sons and three adopted sons between the ages of 12 and 17 and was the only adult in the home.

Last year, Martinez received an award for his dedication as a foster parent. FULL STORY

My first inclination was to condemn Martinez as a pervert with a badge. An AFRA member pointed out that this might be a false allegation.  My retort was "He doesn't deserve any better treatment than we got when we were falsely accused".  The AFRA member shot back at me "EVERYBODY deserves better treatment than we got".  I had to agree that "Yes, this is true".  Whether Martinez is Guilty as sin or Falsely Accused, either way the system is corrupt.

The N.J. Superior Court in Morris County has placed a gag order on the parties involved in the N.J. Division of Youth and Family Services case against Christian homeschooling parents John and Carolyn Jackson.

As reported yesterday by WND, DYFS took the five Jackson children away from their parents on April 16, 2010, citing an imminent danger to the children after the youngest, 2-year-old Chaya, was hospitalized. The parents have been fighting in court to regain custody.

According to a source who asked not to be named, the judge hearing the case, Michael Paul Wright, imposed the gag order Wednesday afternoon upon the request of DYFS. WND called DYFS to inquire about the case early Wednesday afternoon, and posted a news story on the WND website early Thursday morning.

Army Maj. John Jackson confirmed to WND today that he is under a gag order and is no longer allowed to talk to the media about the case.

"Typically, one of the parties would motion the court to impose a gag order," said N.J. attorney William Baer. "In this case, considering the Jacksons were openly speaking to the press, it would seem plausible that the motion originated with DYFS. This case has been going on since last spring, with, to my knowledge, no imposed restrictions on communications. So, why was this gag order issued now? Was it in response to a reporter recently asking questions of DYFS regarding this case? Seems very likely to me.

"In cases involving minors, courts are inclined to defer to DYFS, which ostensibly is protecting the interests of the children. We must also keep in mind that both DYFS and the courts are essentially agents of the state."

Uptick in Febrile Seizures Tied to Flu Vaccine

The FDA and CDC have detected an increase in reports of febrile seizures among children younger than 2 who received Fluzone, the trivalent inactivated influenza vaccine made by Sanofi Pasteur.

Fluzone is the only vaccine recommended for use during the current flu season in infants and children from 6 to 23 months of age.

The agencies are working together to investigate the connection, as well as the possibility that other factors aside from influenza vaccination could be involved, according to an FDA announcement.

The reports were submitted to the Vaccine Adverse Event Reporting System (VAERS).

"Data from VAERS are preliminary and serve as a sign or indication that further investigation is warranted," the FDA said.

In the meantime, the recommendation for vaccinating children against influenza -- that everyone 6 months and older should be immunized -- remains unchanged.

The FDA statement noted that all of the children with febrile seizure recovered with no lasting effects and advised parents and caregivers to speak with their children's healthcare providers about any questions or concerns.

"Although febrile seizures can be frightening for the child's caregivers, nearly all children who have a febrile seizure recover quickly and have no long-term effects," the FDA stated. FULL STORY

What utter hogwash this statement is. We certainly would like to see all of this legislation AND the CWLA deposited on the trash heap of history where they belong.  This is no longer "the land of plenty". We are broke, broke, BROKE and headed for 3rd world status. All together this industry is close to a TRILLION DOLLARS annual expense, much of which is utter fraud.

U.S. Supreme Court Issues Landmark Decision: Constitution is Void

ATLANTA, Jan. 18, 2011 /PRNewswire-USNewswire/ -- The U.S. Supreme Court issued a landmark decision that serves to allow judges to void the Constitution in their courtrooms. The decision was issued on January 18, 2011, and the Court did not even explain the decision (Docket No. 10-632, 10-633, and 10-690). One word decisions: DENIED.

Presented with this information and massive proof that was not contested in any manner by the accused judges, at least six of the justices voted to deny the petitions:

"There is no legal or factual basis whatsoever for the decisions of the lower courts in this matter. These rulings were issued for corrupt reasons. Many of the judges in the Northern District of Georgia and the Eleventh Circuit are corrupt and violate laws and rules, as they have done in this case. The Supreme Court must recognize this Petition as one of the most serious matters ever presented to this Court."

The key questions answered negatively by the U.S. Supreme Court was:

"Whether federal courts must be stopped from operating corruptly and ignoring all laws, rules, and facts."

By denying the petitions, SCOTUS has chosen to sanction corruption by federal judges and to allow federal judges to void sections of the Constitutional at will.

William M. Windsor has been involved in legal action in the federal courts in Atlanta since 2006. Windsor was named a defendant in a civil lawsuit (1:06-CV-0714-ODE) in which Christopher Glynn of Maid of the Mist in Niagara Falls, swore under oath that Windsor did a variety of things including the crimes of theft and bribery. Windsor stated under oath that Christopher Glynn made it up and lied about absolutely everything that he swore. Windsor then obtained deposition testimony from Glynn and the other managers of the Maid of the Mist boat ride, and they admitted, under oath, that charges against Windsor were not true.

Despite this undeniable proof, 32-year federal Judge Orinda D. Evans declared that the grandfather of three should not have fought the lawsuit, and she forced him to pay a fortune in legal fees of Maid of the Mist. Windsor appealed to the U.S. Court of Appeals for the Eleventh Circuit, but federal judges Dubina, Hull, and Fay rubber-stamped Judge Evans' ruling. Windsor then took his appeal to the U.S. Supreme Court where the justices said the appeal was not worthy of their consideration (cert denied).

After attempting to get the case reopened with new evidence that proved fraud upon the courts and obstruction of justice, Judge Evans and Judge William S. Duffey committed a variety of crimes and violations of Constitutional rights, as did judges with the Eleventh Circuit. All of this was detailed for the Supreme Court.
