Washington State Sex Offender Unable to Pay for Treatment Goes to Prison


A man given an alternative sentence for child rape has had the sentence revoked because he could not pay for sex offender treatment.

This is lawful, the Washington Court of Appeals has ruled, even if the man did his best to pay. The report that found the man suitable for sex offender treatment and for the alternative sentence also said he would be at "low-moderate" risk of committing another sex offense one day if he did not get treatment. Thus, the court said, if he could not pay for treatment, public safety required his imprisonment for a full conventional sentence—about eight years.

The case is State of Washington v. Christopher A. Miller, No. 68826-0-I, decided December 16, 2013 in Division One of the court.
