Please Take 12 Minutes...
A brief 7-minute professionally-produced video has just come available that talks about a matter that is very important to me. I have watched it and taken action, and now I am asking you to do the same. This is truly a critical issue affecting all of us. Won’t you join me in being part of the solution?

When we were in school

When we were in school, several parents were there on a regular basis helping out in the classroom or the library, chaperoning field trips, or leading special reading or art programs. They were just doing their part to improve our education.

But parents are not allowed in public schools today. Sure, there are those increasingly rare exceptions. But in general, a parent cannot even visit, let alone sit in on a class or become a regular part of the classroom community. And those terrific school districts sprinkled around the country who do still allow parents entrance grant it as a privilege, not as a parental right.

Washington Times columnist Jay Matthews recently lamented this fact in an article called “What’s Wrong with Parents Visiting a School?” Matthews had spoken with two sets of parents, each of whom had asked to sit in on a class with their child, whom they were looking to enroll in the school. In each case – one in Fairfax, VA and the other in Arlington – the answer was a solid, “No.”

That’s not to say schools should open their doors to just anyone. But Matthews’ article highlights the bigger picture – even parents familiar to the school and with children in attendance are being walled out by government regulations and bureaucratic policies.

We have come a long way from the 1986 Department of Education report which asserted – as the first principle in the Classroom section of the report – that “Parental involvement helps children learn more effectively.” And by depriving our schools of the parental presence, these policies have robbed the parents, the teachers, and especially the students of a terrific resource.

So, what if you are that parent and your child is in that school? How can you impact what and how your child learns? The answer is, you can’t.

According to the Supreme Court’s decision in Pierce v. Society of Sisters (1925), citing Meyer v. Nebraska (1923), any government action that “unreasonably interferes with the liberty of parents or guardians to direct the upbringing and education of children under their control” is unconstitutional. That’s the good news.

The bad news is that the Ninth Circuit determined in Fields v. Palmdale (2005) “that the Meyer-Pierce right… does not entitle individual parents to enjoin school boards from providing information the boards determine to be appropriate….” And the current Supreme Court has chosen not to review that court’s decision, leaving it as binding law in the west and as a dangerous precedent for the rest of the country.

So once your child steps onto school grounds, you no longer have a say. You have been effectively “walled out,” and the schools can do and teach whatever they want. Here’s what the court in the Palmdale case decided:

“Parents…have no constitutional right… to prevent a public school from providing its students with whatever information it wishes to provide…when and as the school determines that it is appropriate to do so…. Although the parents are legitimately concerned with the subject of sexuality, there is no constitutional reason to distinguish that concern from any of the countless other moral, religious, or philosophical objections that parents might have to other decisions of the School District – whether those objections regard information concerning guns, violence, the military, gay marriage, racial equality, slavery, the dissection of animals, or the teaching of scientifically-validated theories of the origins of life.”

Please take a few minutes to see for yourself how parental rights in America are being eroded right under our noses. Then find out what you can do to stop it.

Will schools continue to wall out all parents as they have in recent years? That remains to be seen. But one thing we already know – we as parents are powerless to stop them, unless we take a stand and demand that traditional parental rights be restored!

Overruled 2.0 Launch - Please Help

When we released Overruled: Government Invasion of Your Parental Rights on November 17, we were modestly pleased that it scored nearly 37,000 views in the first week. and we were very grateful for the wonderful comments many of you left us on YouTube. But that is not nearly enough for it to go viral.

Frankly, with an email list of more than 120,000, we were hoping to generate a lot more views than we did. I know it’s a busy time of year, but this is a remarkably easy way to support a very important cause. As one person commented, “This is very possibly the most important 35 minutes you will spend in front of your computer this year, and maybe in your life!”

While we really appreciate all of you who watched, we know we can do better if more people decide to help.

As it turns out, we had to make a few minor edits, which unfortunately meant a whole new upload to YouTube and a brand new viewer count. So now we get a second chance to give Overruled the kind of launch this issue really deserves. Here’s how you can help:

First, if you haven’t watched it yet, we urge you to do so. Watch it, comment on it, give it a thumbs-up, and pass it on to your friends. And be active about it. Don’t just post it and leave it. If you post it, follow up and ask your friends if they’ve watched it yet. Everyone in America needs to know what is going on and how the Parental Rights Amendment can help.

If you’ve already seen it, we need you to “watch” the movie again. I put that in quotes, because you don’t actually need to sit and watch it again. We know you’re busy. But if you could load the video on your computer and just let it play, that will boost the count and help move the new video up the popularity list so others will find it and watch. This helps the video “go viral,” which means it gets spread all over the country without us having to drive that growth. (Of course, you could also invest a second viewing in showing it to someone who hasn’t seen it yet!)

And again, we urge you to actively promote the video. In addition to spreading the link (which is a terrific start if it is all you can manage), specifically encourage your friends and family to take the time to watch this vital production.

But the "Best Interest of the Child" concept under Parens patriae was fully implemented in the United States beginning with CAPTA '74.

So the truth is, the Convention on the Rights of the Child has been supplanted into law and already DE FACTO in force.

There is likely no phrase in our language more dangerous to children than "the best interests of the child", because it's the banner enabling the unconstitutional government officious and tyrannical intrusion into families FULL STORY

Candidate Vows to "Withdraw the Signature of the United States" from the CRC, Endorses Parental Rights Amendment


On Monday presidential hopeful Rep. Michelle Bachman (R-MN) in an address to the conservative Family Research Council made very clear her support of parental rights and her opposition to the UN Convention on the Rights of the Child (CRC).

“[The CRC] threatens the most basic unit of government that [we] attempt to defend – the family. As president, I will withdraw the signature of the United States from this treaty and every other unratified UN treaty of this type,” Bachman said.

She also added very succinctly, “I was an early co-sponsor of the Parental Rights Amendment and I will assure passage of this as president.”

Like you, we want parental rights to be part of the political discussion going into the 2012 elections, and we get excited whenever a candidate brings it up.

So where are the other candidates in this discussion? We’d like your help to ask them that.



Action Items
1. Please take a moment to email each of the candidates below and ask them where they stand. Tell them you have heard Michelle Bachman’s position, that she supports the Parental Rights Amendment and also supports withdrawing the U.S. signature from the Convention on the Rights of the Child. Ask them what their position is on these two documents and why. And tell them that if they support parental rights, they should say so in their platform and in televised debates.

Parental Rights in Danger - Pass It On!
Things are getting ready to break wide open in the next few weeks. You may already be aware of Overruled, the new 30-minute docudrama about parental rights scheduled for release on November 1. But there are also developments in Congress that should lead to some big news very soon.

In the meantime, here are some quotes and stories to consider and pass along. Every American should care about parental rights. Those who don’t simply aren’t paying attention to some of the things going on in our country. Consider:

In 2005, the U.S. Ninth Circuit “affirm[ed] that the Meyer-Pierce [fundamental parental] right does not extend beyond the threshold of the school door.” They also held that “[p]arents…have no constitutional right…to prevent a public school from providing its students with whatever information it wishes to provide, sexual or otherwise, when and as the school determines that it is appropriate to do so.”1

In 2007, the federal District Court for the district of Massachusetts held that “Parents do have a fundamental right to raise their children. They are not required to abandon that responsibility to the state. [They] may send their children to a private school…. They may also educate their children at home.”2 So, sending a child to public school is in this paragraph equated to “abandoning your parental rights to the state.”

In 2008, the Maryland Board of Education announced, “While we recognize the right of parents to direct the education of their children, we must bend their will to the state’s obligation to educate its citizens.”

Nor do such problems exist only for parents with kids in public schools.

In Roper v. Simmons (2005), and in Graham v. Florida and Sullivan v. Florida (2010), the Supreme Court overthrew the laws of Texas and of Florida, writing, “the Court has referred to the laws of other countries and to the international authorities as instructive for its interpretation of the [U.S. Constitution].”3 In both instances, they applied the UN’s Convention on the Rights of the Child to United States law, though we have not yet ratified this dangerous treaty.

Last year, a judge in Philadelphia cited the concept of “Customary International Law” in applying an optional protocol to the UN’s Convention on the Rights of the Child to a federal court case. And the number of judges applying international standards in our courts seems to be increasing.

Daytime curfews around the country threaten the right of home-schooled and private-schooled children to move freely in public without harassment from law officers during public school hours. California just passed a law allowing children as young as 12 to consent to the Gardasil vaccine without parental knowledge or consent. Minnesota already allows the same thing. In Virginia, the vaccine is even mandated by law, the state having made the decision in parents’ stead.

It seems every week brings more violations of parents’ liberty to make decisions for the good of their children. It almost makes President Reagan’s words sound prophetic: “We will spend our twilight years telling our grandchildren what it was like to live in America when men were free.”

But we are not doomed to that yet. In fact, I expect to bring very good news next week, news of our efforts to turn back the tide by adopting the Parental Rights Amendment.

California Further Erodes Parental Rights
In its 1979 Parham decision1 the U.S. Supreme Court held as a foundational principle of American law the “presumption that parents possess what a child lacks in maturity, experience, and capacity for judgment required for making life’s difficult decisions. More importantly, historically [American law] has recognized that natural bonds of affection lead parents to act in the best interest of their children.”

Unfortunately, that respect for parental rights is no longer the standard2 – and it eroded even further this past weekend when California governor Jerry Brown signed into law AB499 allowing children as young as 12 to make their own decisions regarding the Gardasil vaccine.

As constitutional law professor and former U.S. Magistrate Judge William Wagner warns in "God, Government, and Parental Rights," a chapter he wrote for the book Vaccine Epidemic, "the freedom of conscience and the sanctity behind parents directing the upbringing of their children no longer serve as moral benchmarks against which to measure whether government vaccination laws are right or wrong, good or bad, just or unjust. Instead, parents are told that questions regarding vaccination laws are public policy matters for the government to decide."3

The National Vaccine Information Center (NVIC) opposes Governor Brown’s decision to sign this law, which NVIC president Barbara Loe Fisher calls “a violation of parental rights and federal vaccine safety law.” In a press release, Fisher warns the law “is making it easy for big corporations and trade organizations, including doctors and drug companies protected from vaccine injury lawsuits, to exploit ordinary people to increase influence and profits.” That’s because the power to say “No” has been transferred from an experienced adult to an impressionable child.

California is not the first state to pass such a law – Arkansas, Alabama, South Carolina, and several other states4 allow minors to make such decisions without parental protection, and Minnesota has already lowered the bar to age 12 – and they will likely not be the last. It may be that your state has already taken that power away from you.

If they haven’t yet, it is likely they will. Progressive bureaucrats and special interest groups continue to push the notion that the government must make every decision, lest even one child fall victim to bad parenting.

In 1979, the Court called this mindset “repugnant to American tradition.” Children must be protected, but freedom must be protected, too.

Nevertheless, The American Academy of Pediatrics in California this weekend said “[We] support parental-teen communication, and in a perfect world, all youth would be able to speak openly with their parents or guardians about every health decision. Unfortunately, that is not always the case.”

So, does the existence of a few bad parents, a few difficult situations, justify the violation of the natural, longstanding rights of all fit parents? California has decided that it does. And if your state doesn’t already agree, they will likely be next.

Adoption of the proposed Parental Rights Amendment to the U.S. Constitution can restore the legal presumption that was the foundational standard in the Parham case. It can protect the natural right of fit parents to provide the love and wisdom needed in making medical decisions for their child.

As further erosion occurs, we must step up our efforts to turn back the clock on parental rights, to restore the standard that kept our children safe.
