This conflict of interest has resulted in devastating consequences: children's best interest, their health and welfare have been sacrificed by for corporate profits.
Bakan cites childhood obesity resulting from irresponsible advertising by the purveyors of junk food. And the proliferation of toxic chemicals in children's environment that have undermined their health. And he cites under-regulated pharmaceutical industry practices, noting that corporate deception led to widespread prescribing of psychotropic drugs for children:
"we medicate increasing numbers of children with potentially harmful psychotropic drugs, a trend fueled in part by questionable and under-regulated pharmaceutical industry practices.
In the early 2000s, for example, drug companies withheld data suggesting that such drugs were more dangerous and less effective for children and teenagers than parents had been led to believe.
The law now requires "black box" warnings on those drugs' labels, but regulators have done little more to protect children from sometimes unneeded and dangerous drug treatments."
While the statement is true, readers are not informed about the actual scope and magnitude of the deceptive practices by pharmaceutical companies and their professional healthcare "partners" in government and academia that are undermining children's health and welfare.

| CW- We went into negotiate the service plan*(see note) 2 hours later we left with nothing removed from it (now there's accusation of drug abuse, apparently we were cooking meth in the home now too according to them its why the house caught on fire, we need to sign up for welfare even though we wouldn't qualify and HAVE to use their service providers and offer full releases to ours) no changes made or offered come back next week we will talk. The next day we got a call the service plan is not negotiable, visitation is not either. By the way we have canceled the next meeting to negotiate on this service plan. Oh yeah we are separating your kids. The babies can stay in the house where your eldest was bit by one of their 7 dogs the first day they were there! Feels like retribution to me for not signing the plan .... the social worker candidly told my lawyer they don't have the resources for the visits, but they have them to keep 3 or 4 workers in a service plan meeting for hours- unbelievable. Saving MyDaughter <<<HAVE to use their service provider>>> THEIR service provider will say whatever CPS wants them to say. Just in case you end up in front of an honest judge they wont look like blatant liars. Get your own service provider. There is not much you can do about their lying but you certainly don't have to help them make their lies look plausible. Sorry to hear your involved with those psychotic monsters. A lawyer that is not in their pocket usually helps a lot. It does not seem like your lawyer is doing anything. WHAT IS AN ADHESION CONTRACT?
A type of contract, a legally binding agreement between two parties to do a certain thing, in which one side has all the bargaining power and uses it to write the contract primarily to his or her advantage.
An example of an adhesion contract is a standardized contract form that offers goods or services to consumers on essentially a "take it or leave it" basis without giving consumers realistic opportunities to negotiate terms that would benefit their interests. When this occurs, the consumer cannot obtain the desired product or service unless he or she acquiesces to the form contract.
There is nothing unenforceable or even wrong about adhesion contracts. In fact, most businesses would never conclude their volume of transactions if it were necessary to negotiate all the terms of every Consumer Credit contract. Insurance contracts and residential leases are other kinds of adhesion contracts. This does not mean, however, that all adhesion contracts are valid. Many adhesion contracts are Unconscionable; they are so unfair to the weaker party that a court will refuse to enforce them.
An example would be severe penalty provisions for failure to pay loan installments promptly that are physically hidden by small print located in the middle of an obscure paragraph of a lengthy loan agreement. In such a case a court can find that there is no meeting of the minds of the parties to the contract and that the weaker party has not accepted the terms of the contract.

adhesion contract (contract of adhesion) n. a contract (often a signed form) so imbalanced in favor of one party over the other that there is a strong implication it was not freely bargained. Example: a rich landlord dealing with a poor tenant who has no choice and must accept all terms of a lease, no matter how restrictive or burdensome, since the tenant cannot afford to move. An adhesion contract can give the little guy the opportunity to claim in court that the contract with the big shot is invalid. This doctrine should be used and applied more often, but the same big guy-little guy inequity may apply in the ability to afford a trial or find and pay a resourceful lawyer. (See: contract)

Starting in October, social workers investigating possible child abuse or neglect for the state Department of Children and Families will have to give parents a written notice of their rights, roughly comparable to the famous Miranda warnings that police give to crime suspects.
“Even sophisticated people believe they must speak to DCF,” said Ellington lawyer Michael H. Agranoff, whose office drafted the new law and advocated it for a decade.
Agranoff, who specializes in representing adults in DCF-related cases, calls the new law the “DCF mini-Miranda” and “the Magna Carta of parents’ rights in Connecticut.”

Judge rightly delayed release of Butts mental health records

Columbia County Circuit Judge Ted Grove made the right call when he delayed release of accused murderer Daniel A. Butts’ first mental health evaluation to the public, despite the Oregonian newspaper’s push to have those records made public earlier.
Grove said he rescinded his initial order to release the mental health evaluation conducted in April because there was doubt it would provide a complete picture of Butts’ mental state.
For now, the records will stay sealed under a protective order until the 21-year-old Butts returns from the Oregon State Hospital. Butts was transported to the hospital in early July to undergo a comprehensive mental health evaluation in the lead up to a hearing that will determine whether he is fit to aid and assist in his trial.
The results of his mental health evaluation are expected to be released to the public on Sept. 19, little more than a week before the hearing.
In a trial of this stature – one that is certain to capture the attention of regional and even national media – in which the scales of justice for fallen Rainier Police Chief Ralph Painter have yet to tip, we can afford patience.
Though the evaluation could provide some answers to the many questions surrounding Butts’ alleged deadly action against Painter in January, in the end its release to the public satisfies only curiosity for curiosity’s sake and has no bearing on the substance or outcome of the pending trial.

While a highly controversial campaign featuring doctors and psychiatrists seeks to normalize sexual activity between adults and children of almost any age, the principal expert investigator for a U.S. Justice Department study on child sex abuse warns that the pedophilia advocates are using the same strategy that was successfully employed to make homosexuality a classroom subject for small children in the nation's public schools.
Dr. Judith Reisman recently attended a symposium held by "minority-attracted people" advocacy group B4U-ACT to disseminate "accurate information" on the position that pedophilia is just one more alternative sexual orientation.
"If a foreign country came in and did this to our nation, the nation would be outraged," Reisman told WND today about the B4U-Act event, also attended by J. Matt Barber, vice president of Liberty Counsel Action.
The speakers promoted the idea that the American Psychiatric Association should remove pedophilia from the list of mental defects in its Diagnostic and Statistical Manual of Mental Disorders.
Reisman explained the same strategy was used by homosexual activists in the 1970s when same-sex attractions were removed from the APA's list of disorders. Eventually, the legalization of "gay marriage," the mandatory homosexuality lessons in public schools and the brand-new policy of allowing open homosexuality in the U.S. military resulted.

The Illusion of Safety

Recent incidents of violence in Norway and London have made us understandably uncomfortable here at home, as many fear that a worsening economy will lead to violence and unrest in American cities. This is why Congress must view the economy as its first priority and a matter of national security: unless and until we get our fiscal house in order to foster economic growth, civil society will continue to deteriorate.
The fundamental lesson every American should learn from these incidents is that government cannot protect us. No matter how many laws we pass, no matter how many police or federal agents we put on the streets, a determined individual or group can still cause great harm. Both Norway and England have strict gun control laws, and London in particular has security cameras monitoring nearly all public areas. But laws and spy cameras are useless in the face of lawless mobs or sick mass killers. Only private individuals on the scene could have prevented or lessened these tragedies. And we should remember that theft, arson, and property damage were not the only criminal acts in London--innocent bystanders were assaulted and killed as well. In those instances deadly force used in self-defense would have been fully justified.
Perhaps the only good that can come from these terrible events is a reinforced understanding that we as individuals are responsible for our safety and the safety of our families. This means, frankly, that we must safely own and use firearms to deter or prevent criminal assaults on our homes and persons. It is absurd to think police or government agents can protect 310 million Americans around the clock.
Thanks to our media and many government officials, however, Americans have become conditioned to view the state as our protector and the solution to every problem. Whenever something terrible happens, especially when it becomes a prominent news story, people reflexively demand that government do something. This impulse almost always leads to bad laws, more debt, and the loss of liberty. It is completely at odds with the best American traditions of self-reliance and individual responsibility.
Do we really want to live in a world of police checkpoints, surveillance cameras, and metal detectors? Do we want to imprison every disturbed or alienated individual who fantasizes about violence? Do we really believe government can provide total security? Or can we accept that liberty is more important than the illusion of state-provided security?
Freedom is not defined by safety. Freedom is defined by the ability of citizens to live without government interference unless they use force or fraud against others. Government cannot create a world without risks, nor would we really wish to live in such a fictional place. Only a totalitarian society would even claim absolute safety as a worthy ideal, because it would require total state control over its citizens’ lives. Liberty has meaning only if we still believe in it when terrible things happen and a false government security blanket beckons.

Lawsuit Hope and Hype ... See the cute little blue fellow?
He's hoping.
Not that hope isn't a good thing.
Hope based on truth is a good thing.
Unrealistic hope is not.

In other words, hope based on hype is foolishness.
Received favorable responses to our last Tips & Tactics yet some still hold legal mythology is better than learning the official rules and how to use official rules.
I want you to WIN ! ! !
But, you cannot win hoping on hype ... no matter how promising the hype may seem.
Sure, it would be great if you could get out of paying a speeding ticket by claiming you copyrighted your name so the courts can't use your name without your permission, or that your name in ALL CAPITAL LETTERS isn't "you", or that you're a "person" not a "citizen" and therefore above the law and no longer subject to government force.
It would be great to go about doing as you please with no regard to man's law, claiming you're serving God when, by the way, scripture tells us to obey those in authority over us (and, yes, you could insist no one has authority over you).
But, I want you to WIN in court!
You will not win if you refuse to learn the rules and how to use the rules to get justice legally.
You will not win if you show up in court with silver-bullet methods to "get around the law".
Sure, once in awhile someone skips out of a busy traffic court by getting the judge exasperated with internet legal mythology, but I've been to court more than a few times since 1986 when I was first sworn in (and not to any British agency, by the way!) as a member of the Florida Bar. I've seen judges get exasperated and let people off scott-free. I've seen many more escorted by the bailiff to a cell where they were left to decide if they wished to be subject to the official rules.
You choose.
We all have that choice.
It's our prerogative in this wonderful nation.
Go to court with legal mythology sold by those who wish you to believe you are "above the law of the land", or go to court knowing how to use the official rules to get Justice the American Way ... according to law!
