Excess of Jurisdiction

Excess of Jurisdiction

Excess of Jurisdiction is a court's acting beyond the limits of its power, usually. in one of three ways:
(1) when the court has no power to deal with the kind of matter at issue,
(2) when the court has no power to deal with the particular person concerned, or
(3) when the judgment or order issued is of a kind that the court has no power to issue.

2. A court's departure from recognized and established requirements of law, despite apparent adherence to procedural form, the effect of which is a deprivation of one's constitutional right. It is also termed excess jurisdiction.

  2. if a family abuse psychologist was willing to write a letter on your behalf against a sexual abuse allegation, what specifics should you request to be included in the letter?

    1. I would imagine that the "family abuse psychologist" is offering his professional opinion that you were unlikely to have done sexual abuse because....

What he writes would be what he believes. He is supposed to be a professional, and this sort of testimony is what he is supposed to have been trained to do.

What you want to be included in the letter is something that is good evidence you didn't do it.

This is another item that would be filed ON THE RECORD with the court clerk, including the Proof of Service-

Likewise, you need to get YOUR version of history ON THE RECORD with your Sworn Declaration-

which is also filed ON THE RECORD with the court clerk, including the Proof of Service
