...Our state is one of only six states (Texas, Nevada, Wyoming, Wisconsin and Virginia) that allow jury trials for such cases. In Oklahoma, parents may CHOOSE between a jury trial or a bench trial (where a judge rules on the termination) and this process is rare nationwide. I'm convinced this current process contributes to having a system where Oklahoma foster children are subjected to sexual abuse, violence and neglect at a rate four times the national norm.
...Even with bench trials, parents involved in termination cases have all the benefits and protections of due process without the option of a jury trial. They, as the child does, have the right to an attorney and the ability to appeal the outcome. They have the right to have an experienced and impartial jurist hear the case who is familiar with the history of the prior proceedings in the case. In most cases, the same judge handles the case from beginning to end and having a final judgment derived will a full understanding of the history is advantageous.
Getting rid of jury trials in parental termination cases would get children out of the foster care system and into stable, happy environments quicker...

Then what, pray tell would be the view of a Red Fist Communist?
The national problem is that child abuse is prosecuted as something "special" where NOBODY gets any Constitutional Rights.
Especially the CHILDREN do NOT get their Fourth Amendment Right "...to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
