D.C.'s child welfare system leaves kids at risk

The District's child welfare system is failing the city's abused and neglected children in critical ways, a D.C. inspector general's report has found.

More than three years after four girls were found murdered by their mother in their Southeast Washington home, problems continue at the city's Child and Family Services Agency, the report found. The Banita Jacks case and its fallout led to the firing by then-Mayor Adrian Fenty of several city officials and promises of major reforms.

But the inspector general found morale remained low at CFSA, case loads for social workers are still too high, and there is too much pressure to close cases quickly, all of which erodes care for the city's vulnerable youths.

"The children are endangered if these issues go unresolved," D.C. inspector general spokesman Roger Burke told The Washington Examiner on Thursday. "Social workers will not be able to protect the children."

A Child and Family Services spokeswoman declined to comment beyond the agency's responses included in the report.

Ward 1 D.C. Councilman Jim Graham, whose committee oversees that agency, said he'll give a "serious" look at the inspector general's report, which was released Thursday.

"I am deeply concerned about any kind of repeat of the gross neglect that lead to the death of Banita Jacks' children," Graham said.

The inspector general made 23 recommendations to improve the system. Key among them was improving the city's child abuse hot line so investigators spend less time on frivolous cases. FULL STORY

It’s been more than a decade since Child Protective Services entered Gary and Melissa Gates’ Houston-area home and removed their two biological kids and 11 adopted ones, following an allegation the pair had emotionally abused one of their children. Within three days, a judge had returned all the children to their parents; within eight months, the child welfare agency had dropped its case.

But the Gateses, along with half a million other people, remain listed in a statewide database of people who mistreat children — a registry that often precludes child care jobs, foster care and their life’s work, adoption.

“From my side of the socioeconomic scale, this is nothing you’d ever think would happen,” said Gary Gates, who has spent “well north of $500,000” trying to get off the registry, and to hold CPS accountable for the trauma he says his family has endured. “The reality is, very few people have the emotional and financial fortitude to fight this.” FULL STORY

Mass. has highest child abuse ranking

Massachusetts ranks No. 1 nationally for the highest rate of child abuse — mostly involving neglect — a ranking that officials say derives from the state's strict reporting laws.

Massachusetts had the highest rate of child abuse of any state in federal fiscal 2009, the latest year for which statistics are available, as well as in 2007 and 2008. Also, Massachusetts ranked second among the 50 states in 2004 through 2006, according to a report from the U.S. Administration for Children and Families.

Massachusetts' rate for 2009 was 24.2 per 1,000 residents, compared with the national average of 9.3. The Washington, D.C., rate of 28.8 was the highest. While maltreatment covers all forms of child abuse, including sexual, physical and psychological, about 78.3 percent of cases involved neglect.

Jennifer Kritz, a spokeswoman for the Massachusetts Department of Children and Families, said it is difficult to make reliable comparisons between states because of different levels of mandatory reporting. Each state also has its own definitions of child abuse and neglect that are based on federal standards. She said that Massachusetts has some of the strictest laws, thus the state has a higher rate.  FULL STORY

Los Angeles- A bill in the state legislature, AB 73, which would have opened dependency court hearings to the public, was put on hold Tuesday, and that’s a shame in our view.

The bill, authored by Assemblyman Mike Feuer (D-Los Angeles) was one of the few solutions under consideration to improve the outcomes for children in the child welfare system that would have allowed greater transparency in how we treat children who find themselves in the system through no fault of their own.

Too often, children are returned to parents whose actions were the cause for them being placed in the system in the first place, only to be returned to foster care when those same parents prove once again to be incapable of providing a safe and healthy home. FULL STORY

Florida Joins States Calling for Parental Rights Amendment
Florida today became the fifth state to pass a resolution calling on the U.S. Congress to propose to the states for ratification the Parental Rights Amendment to the U.S. Constitution. The Florida Senate voted 38-0 in favor of SM 954 this morning, after the Florida House passed its companion (HM 557) by a voice vote on Tuesday.

Florida becomes the third state this year to call for the Amendment; Idaho and Montana both passed similar measures in early March. Both South Dakota and Louisiana passed similar resolutions in 2010.

Louisiana’s resolution was accepted unanimously in both houses, with a Democrat plurality in the House (then made up of 52 Democrats, 50 Republicans, and 3 Independents) and a Democrat majority in the Senate. Florida’s resolution enjoyed a Republican majority in both houses, but was also bipartisan with 10 of 12 Senate Democrats voting in favor (1 was absent, and 1 did not vote). In all, Florida Democrats on record voted 17-3, or 85%, in favor of this memorial (resolution). Republican support was 98%.

Parent Advisory: Be advised that this article mentions what Philadelphia is shipping free to 11-year-olds, though your children may not yet be ready to read about them.

According to an article at Fox News, the city of Philadelphia has begun a new campaign to engage children as young as 11 in the use of condoms.

A new website set up by the city’s Health Department to promote the campaign offers, “If you live in Philadelphia and are between the ages of 11 and 19, you can now have condoms mailed directly to you for FREE.
  

Maybe it’s difficult for you to stop by one of our sites to pick up condoms. Or maybe you’re just shy or feeling weird about picking up condoms.”

The free service does not require parental consent or even parental knowledge.

How is this legal? In a 1998 case regarding condom distribution in Philadelphia’s schools, the U.S. Court of Appeals for the Third Circuit determined that if “the program lacks any degree of coercion or compulsion…neither an opt out provision nor parental notification is required by the Federal Constitution.” Parents United for Better Schools, Inc. v. School District of Philadelphia Board of Education, 148 F.3d 260 (1998). 


Since children are not compelled to ask for free condoms, the offer by the city doesn’t constitute a violation of parental rights according to the courts.

So your child can’t take an aspirin at school without a parent’s letter and the consent of the school nurse, but he can have a condom shipped right to his door – to your door. It is worrying that anyone would be encouraging 11-year-olds to make independent decisions about sex. To do so on your tax dollars only makes matters worse.

3-Year-Old Girl In Foster Care Killed

HAMMOND, La. -- Tangipahoa Parish detectives are investigating the death of a 3-year-old girl who died while in the care of her foster parents, according to family members.

Faith Saucier died about a week ago, and was buried Friday. Authorities now say her death is a homicide.

"She didn't deserve none of this. The sweetest little thing. She didn't deserve none of this," said Ashley Saucier, Faith's biological mother.

Ashley Saucier battled drug problems for years, so she put her daughter into the state's foster care system. Last Friday, she laid her to rest in the remote family grave in Varnado.

"I want whoever hurt my baby, and killed my baby, to be in jail," she said.

Saucier's attorney, William Arata, showed WDSU the Tangipahoa Parish coroner's report he obtained on Faith, showing the manner of death was homicide.

"Blunt force trauma, sub-scalpular hemorraging about the head along with two perforations of the small intestines," said Arata, reading from the report.

The report also included pictures of apparent bruises on Faith's arms and neck.

"Soon thereafter, I was informed there was a gag order. Nobody's presented me with a copy of this alleged gag order," Arata said.

And that's apparently why few people are talking about Faith's death. The sheriff's office said the gag order was issued by 21st Judicial District Juvenile Judge Blair Edwards.

The sheriff's office will only confirm it has launched in investigation into the child's death.  FULL STORY

Americans depend more on federal aid than ever

Americans depended more on government assistance in 2010 than at any other time in the nation's history, a USA TODAY analysis of federal data finds. The trend shows few signs of easing, even though the economic recovery is nearly 2 years old.

A record 18.3% of the nation's total personal income was a payment from the government for Social Security, Medicare, food stamps, unemployment benefits and other programs in 2010. Wages accounted for the lowest share of income — 51.0% — since the government began keeping track in 1929. FULL STORY

New child protective services program on way

HAMILTON, Ohio — Butler County is one of eight counties in the state that will participate beginning this summer in the Differential Response program developed by the Ohio Supreme Court and the state Department of Job and Family Services.

The pilot program is under way in several counties and with the addition of eight more, 33 counties will have options when responding to and addressing children services reports.

Differential Response gives caseworkers freedom to use an alternative approach when investigating some reports of child abuse and neglect, according to the Supreme Court. That freedom helps keep families together and reduces the number of children placed in out-of-home care, all without compromising child safety. FULL STORY

Gov. John Hickenlooper has proclaimed today, April 26, as Colorado`s first Drug Endangered Children Awareness Day -- a day to recognize the risks children face growing up exposed to substance use, distribution, cultivation and manufacturing in their homes.

Parental substance use or involvement in the illegal drug trade is a leading factor in child abuse and neglect cases in Colorado. Children whose parents abuse alcohol or drugs are three times more likely to be verbally, physically or sexually abused and four times more likely than other children to be neglected. Recently-released court documents prove that the consent form Maryanne signed agreeing to give her daughter the highly-dangerous anti-psychotic drug Risperdal was optional, and that she was always free to cease using them at any time.

In other words, the raid conducted by state-sanctioned thugs on behalf of Child Protective Services (CPS) was nothing more than an illegal kidnapping by armed terrorists who violated Maryanne and her family's legal, civil, and God-given rights. At this point, Maryanne truly has a fully-validated case against CPS and its criminal cabal, should she decide to pursue aggressive legal action against them. After all, they illegally broke into Maryanne's home and proceeded to kidnap her child without just cause.

The consent document Maryanne signed clearly states that she would "not be forced" to administer the medication, and that her daughter was free to "stop taking it at any time." Maryanne had also consulted with another doctor, who recommended that she stop using the deadly drug and instead pursue alternative options -- which clearly proves that the child was not being neglected as some have accused.

"I think that document proves our case," said Wanda Evans, Maryanne's lawyer in the case. "She understood she had a right to stop giving the medication. If you sign an informed consent that says you can stop, and you stop, you did the right thing, and CPS is just being nasty."

A Bronx teen sought refuge at a facility designed to help patients like her - vulnerable teens battling emotional issues.

But once inside Metropolitan Hospital's child psychiatric ward, the 15-year-old girl was forcibly sodomized by another patient - an 11-year-old boy, authorities said.

"When my daughter told me what happened, I felt like a knife had pierced me in my heart," the victim's mother, Patricia Watson, told the Daily News.

"The hospital failed to protect her. They failed to protect my daughter."

The teen's torment has only compounded in recent weeks because she is still in the same unit where she was attacked last month, awaiting a transfer to a state facility.

"She has panic attacks when she's in her room, when she's in the shower," Watson said. "I feel heartbroken my daughter is still there. She should have been moved within hours." FULL STORY

More than 25 percent of inmates in Maricopa County Jail admit to being diagnosed with mental illness, so Sheriff Joe Arpaio stood a good chance of offending mental-health advocates when the Sheriff's Office recently launched a new online contest asking website visitors to vote for their favorite inmate-booking photos.

It took less than 24 hours for Arpaio to hit a nerve.

When the site debuted this week, 48-year-old Barbara Cyran - listless, unkempt and with a bit of spittle below her lip - was among the fan favorites.

Cyran is also mentally incompetent to stand trial, according to court-appointed experts whose opinions have led to the dismissal of trespassing and prostitution charges against her in the past two years.

Considering the residents of Arpaio's jails, many of whom deal with some combination of substance abuse, mental illness and physical ailments, the outcome of the online mug-shot game was predictable, said Charles "Chick" Arnold, a Phoenix attorney and longtime advocate for the mentally ill.

"While we might risk advancing (Arpaio's) publicity component, I think it's critical that we try to get in the way of this and stop this kind of exploitative behavior - because that's exactly what it is," Arnold said. "What he's doing seems to be to be exploiting people who have been defined in our state as vulnerable adults. That's offensive."

Offensive or not, the contest accomplished the sheriff's stated goal of bringing users to his website: Arpaio's new Web page attracted more than 135,000 visitors in its first four days of existence. The same page drew 191,000 visitors over the 30 days before that, according to the Sheriff's Office. FULL STORY

Texas mom Hannah Overton, who began serving a life-without-parole sentence in 2007 after jurors convicted her of killing her 4-year-old foster son by giving him large amounts of salt, may be innocent, according to a prosecutor in the case.

Overton's case gained publicity because of prosecutors' conclusions that Andrew Burd, who was being adopted from a background of drug use and abuse by his birth mother, died because he had ingested too much Zatarain's Cajun Seasoning.

But one of the prosecutors, Anna Maria Jimenez, now has submitted a letter to an appellate court as part of a defense request for a new hearing. Jimenez says defense lawyers did not receive a doctor's report in the case documentation showing Burd did not have high salt levels in his system.

The report was found in the prosecution file by defense attorney Cynthia Orr as part of her appeal preparations. It stated that studies by Dr. Fernandez, a medical examiner, to assess the level of sodium chloride showed "there was an indication that the gastric contents of Andrew Burd did not have a high sodium chloride level."

According to Jimenez, however, the report was missing from the file that the prosecution team had provided to a physician for evaluation before testifying in the case. It also was not given to the defense, which would have been a standard procedure for such exculpatory evidence in criminal cases. FULL STORY

The horrific discovery of little Faheem Williams' mummified remains in the Newark basement of a relative's home prompted a $1 Billion overhaul of New Jersey's Department of Youth and Family Services in 2003, but eight years later, the state is paying for mistakes of its past.

Susan K. Livio of the Statehouse Bureau reported that New Jersey spent approximately $51.7 million in 317 lawsuits brought on behalf of foster children who were abused while in state foster homes from as far back as 1996.

Attorney Joel Garber of Voorhees said while he hoped the system changed, he was not very optimistic since it's too hard to police what really goes on in foster homes. FULL STORY

WASHINGTON--(BUSINESS WIRE)--The nonprofit educational organization, the National Vaccine Information Center (NVIC), is calling on the American Academy of Pediatrics (AAP) leadership to stop bullying parents and do more to urge pediatricians to become compassionate partners with parents in preventing vaccine reactions, injuries and deaths. NVIC is responding to an April 13, 2011 letter that AAP President O, Marion Burton, M.D. wrote to CBS pressuring the network to remove a 15-second message on the CBS Jumbotron in Times Square encouraging informed vaccine decision-making.

In the early 1980’s, the AAP successfully lobbied Congress to shield vaccine manufacturers and doctors from civil liability for vaccine injuries and deaths in the National Childhood Vaccine Injury Act of 1986. At the same time, NVIC co-founders worked to secure vaccine safety informing, recording and reporting provisions in the 1986 law, which has paid out more than $2 billion to the vaccine injured since 1988.

In recent years, the AAP has been criticized for failing to divulge to the public the amount of money it receives from vaccine manufacturers. On April 18, 2011, The Orange County Register published a retraction for printing Paul Offit’s defamatory accusation that veteran CBS journalist Sharyl Attkisson lied when she accurately reported in 2008 that Offit failed to inform CBS about exactly how much money he and his employer, Children’s Hospital of Philadelphia, are paid by vaccine manufacturer Merck.

“The AAP leadership is destroying the trust that should exist between parents and pediatricians. Instead of leading by example and encouraging pediatricians to first, do no harm, they are acting like bullies. It is a shame,” said Fisher.

Mother says state erred in taking her children

SANTA FE, Texas — A state Child Protective Services worker took a Santa Fe woman’s two children only to have a judge reunite the family the next day, a family attorney said.

A spokeswoman for Child Protective Services said the state generally doesn’t comment on issues involving juveniles, but it hasn’t received a complaint on the matter.

The decision, which left Gala Teel without her two boys, isn’t under review, the spokeswoman said. The state still has a temporary conservatorship of the children while they live at home. FULL STORY

Any time a story appears that casts CPS in a bad light, people jump to defend CPS because they "believe" in CPS.

Why?

People who haven't experienced them DO NOT know what CPS is.

1- CPS is NOT the police.

3- CPS "investigations" are NOT actual investigations.

4- CPS agents operate by NO moral or Ethical standards whatsoever

Oklahoma City police sergeant charged in sexual abuse case

The Oklahoma City police sergeant who was honored last year for selfless dedication to children sexually abused four teenage boys in his care, prosecutors alleged Friday in a 37-count criminal charge.

Maurice A. Martinez, 44, also violently struck one of those boys in the head, prosecutors alleged in the charge. Police reported finding a video of that blow on the officer's computer.

The veteran patrol officer is being held without bail in the Oklahoma County jail. Martinez has been under investigation since January when one teenager — an adopted son — told elders at his church he had been molested. FULL STORY

Oklahoma— A July 11 trial date has been set for a former child welfare specialist on charges of neglect of duty and making false entries.

Julie Ann Vinson, 36, of Braggs is charged with:

• Public official neglecting duty. The charge states on or between June 21 and Oct. 31, she willfully neglected to perform her duties as a public officer in failing to investigate alleged abuse of children.

The crime is punishable by imprisonment in the county jail not exceeding one year or by a fine not to exceed $500, or both fine and imprisonment.

• False statement during a state investigation between June 21 and Oct. 31.

The charge states she made false statements after being warned in writing it would subject her to criminal prosecution.

The misdemeanor is punishable by imprisonment for not more than one year, or by a fine of not more than $500, or both. FULL STORY

County loses $4.9 million lawsuit challenge over lying social workers

The County of Orange lost its battle in the U.S. Supreme Court Monday to overturn a record-setting $4.9 million judgment awarded to a Seal Beach woman, after two county social workers lied to a juvenile court commissioner in order to take away the woman’s two daughters.

It took Deanna Fogarty-Hardwick 6 ½ years to regain custody of her children.

The jury award given to Fogarty-Hardwick included damages against the two social workers. The Supreme Court also upheld $1.6 million in attorneys fees for Fogarty-Hardwick’s attorneys, but that could end being as much as $3 million, Fogarty-Hardwick’s attorney Shawn McMillan said.

The county and the two social workers will also be responsible for paying interest which has accrued on the $4.9 million jury award over the last four years, bringing the grand total close to $9.3 million, McMillan said.

Fogarty-Hardwick’s attorneys had offered to settle with the county for $500,000.

Orange County Social Services social workers Marcie Vreeken and Helen Dwojak filed false reports and held back evidence which would have cleared Fogarty-Hardwick, an Orange County jury found. Vreeken would later be promoted, according to county records.

A third social worker was found not liable.

According to court papers, Vreeken threatened that if Fogarty-Hardwick did not “submit” to her will, she would never see her children again. The social workers also tried in 2000 to coerce Fogarty-Hardwick to sign a document saying she was a bad parent by threatening to take her daughters away, Fogarty-Hardwick alleged.

She refused. A county commissioner ordered Fogarty-Hardwick’s daughters, 6 and 9, taken from their mother and put in Orangewood Children’s Home.

The girls were later put in foster care.

Fogarty-Hardwick gave her ex-husband full custody in 2002, hoping to protect her daughters. She was then allowed two supervised visits a month for two years. She eventually won 50-50 custody in 2006.

Fogarty-Hardwick sued the county in 2002, arguing the Social Services Agency and its two social workers violated her civil rights. A jury ruled against her.

She sued again, arguing this time county’s policies violated her constitutional rights, including her Fourth and Fourteenth Amendment rights.

Fogarty-Hardwick’s accused the county of violating her constitutional rights by removing her children without making a finding of imminent danger or serious physical injury; interviewing her daughters without a parent present; holding her children without cause; fabricating evidence; and failing to properly train employees about parents’ constitutional rights.

An Orange County jury voted 10-2 in 2007 in favor of Fogarty-Hardwick and awarded her $4.9 million.

The county appealed the judgment.

In the Fourth District Court of Appeal opinion, Justice William Bedsworth wrote, “the evidence adduced at trial obviously caused both the jury and the judge to conclude not only that something seriously wrong was done to Fogarty-Hardwick in this case, but also that the wrongful conduct was not an isolated incident.”

“Despite Fogarty-Hardwick’s complaints, and the concerns expressed by others about the handling of this dependency case, SSA did not investigate the situation or consider assigning different social workers to the matter. Neither of the social workers involved was disciplined. Instead, Vreeken was promoted to supervisor in 2001,” Bedsworth wrote.

The Watchdog is looking into whether Vreeken and Dwojak still work for the county.

“What the county and these social workers did to her was horrendous and she deserves to be compensated in full measure,” McMillan said.

“It’s a big deal for a private citizen to take on the government all the way to the United States Supreme Court,” McMillan said. “(Fogarty-Hardwick) poured her whole life into this case. She provided a valuable service to Orange County and to other parents for having the tenacity to stick with it.”

Acting DCFS head resigns in defiance of supervisors

The acting head of Los Angeles County's often-maligned Department of Children and Family Services has resigned to defy the Board of Supervisors, and the lone candidate to fill the job on a permanent basis has withdrawn, officials said Thursday.

Antonia Jimenez stepped down Tuesday, returning to her old job as a deputy to county Chief Executive Officer William Fujioka. The move was intended to let her avoid entering into a contract that the board had directed her to sign, according to county Supervisor Michael Antonovich.

Antonovich bluntly stated the department was better off without Jimenez because she defied the board's direct order to sign a contract with a relatively new unit created to investigate deaths, abuse and neglect involving children in the care of the DCFS.

"It was a blatant act of insubordination," Antonovich said. "She had until 5 (Tuesday afternoon) to sign, and she stepped down in lieu of signing, in defiance of a court order."

Jimenez did not return multiple calls seeking comment Thursday. But during Tuesday's board meeting, she explained that she had no objections to working with the Children's Special Investigation Unit that replaced the Children's Services inspector general and answered directly to the board.

Jimenez said she merely opposed a provision in the contract that barred her from sharing the investigative unit's reports with staff at the DCFS. FULL STORY

Disturbing Local Child Abuse Survey Indicative of Nationwide Problem?

A disturbing survey out of Pittsburgh could be a warning marker for other states when dealing with mandatory reporters in child abuse cases. According to the survey, at least 20 percent of the people charged by law with reporting suspected cases of child abuse (mandatory reporters consist of law enforcement, medical professionals, teachers, and others in positions of authority with regard to children) do not really understand their legal duty or what is required of them when making a report. Some even made the surprising comment that they didn't know what to do when their calls to ChildLine, the child abuse hotline, went unanswered.

The Protect Our Children Committee, which commissioned the survey, reported that the data showed that as many as 6 percent of respondents did not know their legal obligations. Another 14 percent said they were not trained in the proper procedure to follow when they suspected abuse.

"Even when people said, 'Yes, I'm a mandatory reporter,' their comments suggested, 'I don't really know what that means,'" Cathleen Palm, executive director of the Protect Our Children Committee, told the Pittsburgh Tribune-Review. Former Texas Correctional Officer Sentenced on Conviction Arising from Inmate Beating and Subsequent Cover-Up

WASHINGTON – A former Bexar County Sherriff’s Office Deputy was sentenced today by U.S. District Judge Orlando Garcia to 27 months in prison for depriving a man of his constitutional right to be free from excessive force and for obstructing justice, the Department of Justice announced today. Daniel Melgoza was also sentenced to two years supervised release and a $200 special assessment.

Melgoza, 54, of San Antonio, Texas, was convicted by a jury in San Antonio on Dec. 16, 2010. Evidence at trial showed that on Dec. 8, 2004, Melgoza kicked a compliant inmate in the head several times with pointed cowboy boots. The evidence also showed that Melgoza wrote false reports to conceal his misconduct.

“Correctional officers are entrusted with a great deal of power in order to carry out their critical public safety duties. But they must not be permitted to abuse that power by violating the rights of inmates under their supervision,” said Assistant Attorney General Thomas E. Perez. “ We will not hesitate to prosecute officers who cross the line and injure those they are sworn to protect."

The investigation was conducted by FBI Special Agent Mirella Rodriguez. Civil Rights Division Trial Attorneys Roy Conn and Christopher Lomax prosecuted this case for the United States.
