Thus ended the sermon of 30-year-old pastor John Peter Muhlenberg as he removed his clerical robes to reveal a uniform in the Continental Army.

After church, 300 men of his congregation rode off with him to join General Washington's 8th Virginia regiment.

Born OCTOBER 1, 1746, John Peter Muhlenberg died the same day in 1807.

After hearing Patrick Henry speak the famous words, "give me liberty or give me death," John Peter Muhlenberg approached General Washington and enlisted.

Promoted to Major-General, he endured the freezing winter of Valley Forge and fought at Brandywine, Germantown, Monmouth, Stonypoint and Yorktown.

John Peter Muhlenberg was elected Congressman and Senator.

John's father, Henry Muhlenberg, was a founder of the Lutheran Church in America.

John's brother, Frederick, also an ordained minister, was elected the first Speaker of the U.S. House of Representatives.

Both John and Frederick served in the first session of Congress which passed the First Amendment.

In 1889, Pennsylvania placed a statue of John Peter Muhlenberg in the U.S. Capitol's Statuary Hall.

President Signs Child and Family Services and TANF Extension Acts

Today signaled a major victory for many children and families as President Obama signed two key pieces of legislation, extending benefits to families across the country. First, the Short-Term TANF Extension Act (H.R. 2943) would extend TANF grants to states through the remainder of the year. It does not, however, extend the authorization for TANF supplemental grants, which expired back in June. The President also signed the Child and Family Services Improvement and Innovation Act (H.R. 2883), which reauthorizes Title IV-B through FY 2016 and reinstates Title IV-E waiver authority. CWLA applauds the President on the signing of these important measures.

As I have said repeatedly, I don't believe for a second that anything GOOD is going to happen for families. In a few months, all this will be forgotten and the system will just slouch on with being Nasty Nazis.  As always

Appellate Court affirms mother neglected kids by committing violence against dad

The New York State Appellate Division, First Department, affirmed yesterday a decision by New York County Family Court Judge, Clark V. Richardson, that gave custody of three children to their father after determining that the mother had attacked the father in front of the children.

In the Matter of Aliyah B., the court also stated that the preponderance of the evidence showed that there was educational neglect on the part of the mother, as one child had missed 64 out of 181 days of school and was late 38 ouft of 181 days.

The court also ruled that family court used proper discretion in issuing an order of protection against the mother, and that it was in the best interests of the children that the father had relocated with them to Pennsylvania where the father felt the children's lives would be improved by living with his sister.  FULL STORY

Foster care in Michigan: Maryanne Godboldo's daughter is going home

There's so much good news today it's hard to keep up. But WXYZ-TV is reporting that Maryanne Godboldo's daughter gets to go home to her mother. After weeks of institutionalization, the child had been in the custody of an aunt. The court also ruled that it will not force the child to take any medication. So far there are no further details, including whether or not CPS still gets to pry into the family's life.

UPDATE, 6:05PM: CPS Remains in the family's life at least until December 12.

The U.S. Government Accountability Office (GAO) recently released a report, “Child Welfare: More Information and Collaboration Could Promote Ties Between Foster Care Children and Their Incarcerated Parents” in response to a request by Represenatives Jim McDermott (D-WA) and Charles Rangel (D-NY). The report covers available data on the number of children in care with incarcerated parents, policies and agency strategies for improving these families’ connections, and reccomendations for the U.S. Department of Health and Human Services (HHS) and the U.S. Department of Justice (DOJ) to improve assistance to agencies working with this population.  FULL STORY

National Magazines Promote the UNCRC
Since 37 lawmakers signed on to SR99 back in April, the United Nations’ Convention on the Rights of the Child (CRC) would face a predetermined defeat if it were introduced for ratification in the U.S. Senate. But that hasn’t kept the treaty – by which nations obligate themselves to fulfill “the civil, cultural, economic, political and social rights of children” - from popping up in some generally non-political national publications in the past couple of weeks.

Several of you have commented to us that the last page of a recent edition of Parents magazine includes ratification of the CRC on a 15-item “wish list” the publishers hope to see in the next 15 years. And a recent article by Alex Wolff at CNN-Sports Illustrated’s SI.com promoting sports as a means for international social change and the promotion of peace (both good things) also counts it lamentable that the U.S. has not ratified this dangerous treaty.

In its online version, Parents features a simple slide-show frame (number 12 of 24) that says: “Our Wish: All countries adopt the United Nation Rights of Children (sic), which protects kids from hunger and maltreatment.” The write-up from Sports Illustrated takes the familiar tack of asserting that the U.S. is falling behind the rest of the world by not ratifying the treaty, without actually naming any benefits or pitfalls of said ratification. Readers are not supposed to question the content of the treaty or its impact on U.S law under our Constitution. The rest of the world has ratified it, so we should, too.

I can still hear Mom’s response to that: “And if the rest of the world jumped off the Brooklyn Bridge, would you want to do that, too?

Perhaps someone with connections is pushing for these mentions in unusual places. Perhaps the writers and publishers just honestly don’t know that ratifying the CRC would allow a U.N. committee to set policy that our courts would hold as binding on American families. The writers of Sports Illustrated have shown in the past an understanding that parents are generally the good guys, and that even exceptional children rarely become exceptional adults without their parents leading the way. One would suppose from the title that “Parents” would espouse that same understanding.

So, we must assume these writers simply don’t know what it is they are suggesting. That being the case, here are a few things you may want to do:

1. If you subscribe to either of these magazines, consider writing a letter to the editor informing them that the CRC is not a measure that would be beneficial to children in the United States. By placing UN bureaucrats in the decision-making role currently occupied by fit parents, ratification in our country would actually be a nightmare, not a dream. (Don’t attack the entire article; our issue is just with the uninformed endorsement of CRC ratification.)

Visit the CRC wish page and select “Tell Us” right after “What’s Your Wish?” Tell them you wish for adoption of the Parental Rights Amendment to protect the role of parents in the lives of their children.

Please be courteous and respectful. Address the issue, don’t attack the writer!

2. If you see other such mentions in other national publications, please let us know.

3. Keep spreading the word! This treaty will not go away on its own. Those driving it in the U.S. know that if they can adopt it without the Senate – through the courts using “Customary International Law” and through the press blindly promoting it as a standard we should follow – they can still get around SR99 and win. Only the Parental Rights Amendment can protect our nation from this treaty by every route.

Mother Charged in Alleged DUI Crash that Injured 6 Kids

LANCASTER, Calif. (KTLA) -- A 31-year-old mother is facing more than a dozen felony charges for allegedly DUI crash that injured six children.

Stanesha Nicole Allen pleaded not guilty Tuesday to six counts each of child abuse and child restraint law violation, and one count each of DUI causing injury and driving with a .08% blood alcohol causing injury.

The Lake Los Angeles mother was booked on felony DUI and child endangerment charges after being released from the hospital Monday night.

Bail for Allen was set at $1.7 million.

She is due back in court on Oct. 7 for a preliminary hearing.

If convicted as charged, Allen faces 19-years in state prison.

Authorities say Allen was driving a 2002 Toyota Sequoia eastbound on Avenue I near 60th Street East about 5:15 a.m. Sunday when she lost control of the vehicle and flipped it four times, officials said.

Allen had reportedly attended a wedding the night before.

She picked up the children from a babysitter that morning and was on her way home when the crash occurred, said CHP Officer Joshua Wupperfeld.

Two of the children, who range in age from 10 months to 11 years old, were partially ejected in the crash, CHP officials said.

Investigators say the younger children were improperly restrained in car seats.

Allen's 22-month old foster son suffered major head injuries.

His foot was amputated, and officials said the other would be partially amputated.

Allen's 4-year-old daughter suffered major head trauma.

The boy was in stable condition Monday, while the girl's condition was critical, CHP spokeswoman Sgt. Denise Joslin said.

The other kids, who suffered cuts and bruises, were placed in child protective custody.  As if they weren't already??

Two of the victims are Allen's biological children.

The other four are believed to be foster children.

"These are six innocent children," Wupperfeld said Sunday in a news conference.

"They were harmed because of somebody's selfish mistake."*

The District’s child welfare agency may have unnecessarily removed dozens of children from their homes in recent years, a new study concludes, “emotionally and psychologically harming both children and parents.”

The Citizens Review Panel, an independent, federally mandated oversight board, examined four years’ worth of records — 27 cases handled by the D.C. Child and Family Services Agency from 2006 to 2010, involving 41 children — where emergency powers were used to remove the children from their homes without a court order, only to be returned to those same homes within months.

Finding “too many cases of inadequate investigations and poor removal decisions,” the panel concluded that the city was “generally right to have significant concerns about that families, but .. was often wrong to conclude that removing children from their families on an emergency basis was necessary to address those concerns.” FULL STORY

Late last week, the Senate passed the Child and Family Services Improvement and Innovation Act (H.R. 2883). As reported, over recent weeks identical bi-partisan bills have been travelling through both sides of Congress as a result of bicameral efforts to reauthorize IV-B of the Social Security Act and take steps towards comprehensive child welfare financing reform. The Senate Finance Committee passed S. 1542 early last week, then the full House passed H.R. 2883 mid-week. Now the full Senate has passed H.R. 2883 without objection, by the voice vote process of unanimous consent.  FULL STORY

Adults who are interviewed by DCF must now be advised, in advance, that they can and should seek a lawyer prior to speaking to DCF. This will also, hopefully, help to stop secret talks with the kids in school. It will stop DCF barging into your home under veiled threats of otherwise seizing the kids.

While I do not know enough about this case to specifical­ly advocate for this couple, I know enough about the standard generic operations of CPS to say that this case appears to be typically over-blown and absurd.

This case is a show case of WHAT'S WRONG with the entire CPS system and the lack of Constituti­onal Due Process.

That this case should now rise to the FBI becoming involved certainly adds to the Three-Ring Circus of absurdity.

Parents are held responsibl­e for "Thought Crimes"- of the CPS agent. Whatever the CPS agent IMAGINES becomes a FACT when written up in her report. The colluding mental illness clinicians write reports that have no relationsh­ip to whatever "test" the accused might have taken.

The accused end up bankrupt, homeless, unemployed­, and unemployab­le due to being put on the state Abuser List.

The children have NO FAMILY left.

COUNCIL BLUFFS, Iowa -- A mother calls her life a "living hell" without her two little boys. Nina McNeese's children died instantly in a head-on collision on Highway 48 south of Red Oak just after Thanksgiving last year.

The head-on crash hurt McNeese so badly that she had to relearn how to walk.

Now, McNeese is speaking out in hopes of keeping others and their children safe on the road.

....McNeese and her boys were on their way home to put up their Christmas tree, but they never made it because of a head-on collision with 18-year-old Karli Jo Brown.

Court records show Brown was traveling at 74 mph in a 55 mph zone, texting on a cellphone and passing in a No Passing zone.

McNeese was critically hurt, and her boys -- 4-year-old Alexander and 5-year-old Maliki -- died on impact.

"I had to sit there, pinned underneath a freaking engine while my babies were dead. I couldn't even hold them," McNeese said.

Brown pleaded guilty last week to two counts of vehicular homicide by reckless driving.

....Brown faces up to 20 years in prison, but McNeese said that's not enough.

....McNeese wants drivers to remember to put down the phone.

"When you make these choices, there are bad consequences from them. People die," McNeese said.

Brown's attorney said it was his client's choice to plead guilty and avoid a trial.

"All she can tell me was she certainly wasn't intending on hurting anybody and deals with that every day," Seth Baldwin said.

Baldwin said his client admits speeding and passing in a No Passing zone; however, she maintains she was not texting. Investigators said cellphone records indicate otherwise.

You may recognize Jim Navarro from the documentary film Cut Poison Burn, which I recently posted. You can watch the entire film for free. If you haven't seen it yet, I urge you to take the time to view it now.

Jim is the father of Thomas Navarro, who at the age of four was diagnosed with medulloblastoma, a type of brain cancer. The family ended up in a protracted battle against the medical monopoly after objecting to the conventional treatment, choosing instead to seek out less invasive, less damaging, and less life threatening approaches. However, the medical system's response was swift and callous.

In fact, in the months that followed Thomas' diagnosis, the family went into hiding to keep their son away from the authorities who threatened to take him into custody, charging Jim and Donna Navarro with child abuse and neglect.

The Navarro's wanted to use Dr. Burzynski's non-toxic, highly successful antineoplaston treatment instead of conventional chemotherapy and radiation. However, the FDA went to great lengths to prevent Thomas from receiving the therapy, and only after extensive legal wrangling, great expense, and being forced to submit to conventional treatment first did the family finally receive approval to use Dr. Burzynski. Unfortunately, at that point it was too late. The damage from the chemo was too great, and he lost his battle with cancer at the tender age of six. His death certificate states the cause of death as:

And there are four primary organizations that are responsible for this travesty: the FDA, the American Cancer Society, the National Cancer Institute, and the child services system. These are the white-collar bureaucrats making life and death decisions about people they've never met or cared for in a medical capacity. Their primary objective is to protect the profits of Big Pharma and the cancer industry itself.

Navarro describes the Child Protective Services (CPS) as "the thugs of the doctors, the pharmaceutical companies, and the FDA," and it's easy to see why, when you hear his story.

"When we began, we were completely uncomfortable with everything and we wanted a second opinion. The minute those words are heard: 'second opinion,' CPS is brought into it," he explains. "You're charged with child abuse and medical neglect automatically. The charges go up from there depending on your level of resistance. They will kick in your door; come in armed. They will attempt to kidnap your child, which we had gone through several times with Thomas. By any means necessary they will get your child.

Sworn in February 4, 1801, Marshall served 34 years and helped write over 1,000 decisions, including supporting the Cherokee Indian nation to stay in Georgia.

During the Revolution, John Marshall fought under Washington and endured the freezing winter at Valley Forge.

The Liberty Bell, according to tradition, cracked tolling at John Marshall's funeral, July 8, 1835.

Financial incentives in foster care: WE’VE GOT WAIVERS!


Legislation that marks the biggest change for the better in federal child welfare law in 31 years has passed both houses of Congress and is on its way to President Obama.

“Biggest change for the better in federal child welfare policy” is, of course, a pretty low bar, particularly since almost every other change since 1980 has been for the worse. But this legislation has the potential to make a real difference– if states can be persuaded to embrace it.

That’s because the legislation includes a provision restoring the authority of the Department of Health and Human Services to issue waivers from federal foster care funding restrictions, waivers like the one which allowed Florida to make dramatic improvements in its child welfare system.

The bill was sponsored in the Senate by Sen. Max Baucus (D-Montana) and Sen. Orrin Hatch (R-Utah), and in the House by Reps. Geoff Davis (R-Kentucky) and Lloyd Doggett (D-Texas).

But special credit also goes to Sen. Ron Wyden (D-Oregon) who withdrew last-minute amendments to tack on his own proposal. That easily could have delayed and possibly killed the waivers and the entire bill – which also includes reauthorization of key prevention and family preservation programs.

In a field where everybody says they put the children first, Sen. Wyden really did it; putting personal pride in his own bill aside in order to get the very important legislation through.

So, the waivers soon will be law. Then comes the hard part – persuading states to break their addiction to foster care “entitlement” funding and apply for waivers – in particular big, broad waivers like the one that did so much for Florida.

That was made harder by a series of hoops states will have to jump through to qualify for waivers, provisions added in the Senate at the behest of a child welfare establishment that never really liked the waivers – or anything else that limits the foster care “entitlement.”

So we’ve won a big battle. But it’s a long war.

Yeah. I remember in 2008, all sorts of wonderful things were supposed to come from Fostering Connections to Success and Increasing Adoptions Act.  The actual upshot is, some big piece of the huge system just got reauthorized for another 4 years of terrorizing America's families. These vague promises of "improvement" are nothing but a Carrot on a Stick. I am consistent- I just want to shut down all the money going into this nightmare.  Problem solved.

MILLER, Ohio — A worker from Lawrence County Child Protective Services was injured on the job when a dog attacked him Thursday afternoon.

Ron James was checking on the welfare of children in a household in Miller when the animal, a pit bull mix, attacked him around 2 p.m., Sheriff Jeff Lawless said.

James, who sustained injuries to his arm and face, sought medical attention at a hospital but was not taken by ambulance, Lawless said.

The dog warden was called and the dog will likely be quarantined while officials determine if the animal has had vaccinations, the sheriff said.

The sheriff said there is a possibility that the owners will face criminal charges, either for the well-being of the children or for the dog attack.

Former Luzerne judge Conahan sentenced to 17.5 years

Former Luzerne County Judge Michael T. Conahan was sentenced to 17.5 years in federal prison this morning in the kids-for-cash case.

He was also fined $20,100 and ordered to pay $874,000 in restitution.

Conahan pleaded guilty to racketeering conspiracy for accepting $2.8 million from the builder and co-owner of two for-profit detention centers that housed county juvenile offenders. He faced maximum sentence of 20 years.

Congress Nearing Appropriations Deadline

With the beginning of the new fiscal year just a away, Congress will not have time to complete action on all twelve appropriations bills, and will have to approve a short term continuing resolution (CR) in the meantime. Both chambers have worked on the various bills in some capacity, and earlier this week, the Senate Appropriations Committee approved the FY12 Senate Labor, Health and Human Services and Education Appropriations bill, which allocates spending for discretionary health and child welfare programs and the agencies that oversee these programs. While most programs were flat funded, there were slight increases for the Promise Neighborhoods community transformation program and Head Start. Unfortunately, the bill included a $50 million cut to the Title V Maternal and Child Health Block Grant. The accompanying report language points to future increases in the Maternal, Infant, and Early Childhood Home Visiting Program, as offsets for reductions in Title V funding. The bill also confirms the elimination of the Mentoring Children of Prisoners program from FY 2011.

The House Appropriations Committee has postponed action on this bill, and it remains unclear when they plan to take up the measure. Congress will likely spend next week finalizing a CR that will temporarily fund these programs at their current levels and prevent a government shutdown.

New Report Links Recession to Increase in Child Abuse

On Monday, Sept. 18th the Associated Press (AP) reported on new research released in Pediatrics that links the recession with an increase in abusive head trauma (AHT) among children under the age of one year old. The report adds to a growing body of research on the link between economic downturns and increases in child abuse in the United States.

The study examined counties in regions of Western Pennsylvania, Southern Ohio/Northern Kentucky and the Seattle metropolitan area and included a review of 422 cases of AHT between 2004 and 2009, predominantly involving children from low-income homes. The study found that cases of abusive head trauma increased 65% from pre-recession years to the recession years of late 2007 through 2009.

The characteristics of the victims abused during that time period experienced little change. The average age of the children, the morality rate, the percent receiving public insurance, and the number of children with siblings in the home all remained relatively stable. According to the study’s authors the small level of change in characteristics and demographics of children abused contrasted with the large increase of cases indicates that the recession was a societal-risk factor that increased the risk for everyone. Mark Rank, a professor at Washington University in St. Louis, cited in an interview with AP the combination of the stress of raising a young child with wage cuts or job loss, as factors for potential violence.

The study’s authors hope that their research will aid in provoking a policy discussion on the specific stressors and mediating factors related to AHT, stating that “the greatest improvement in a populations health care are likely to derive from social interventions.”

Am i understanding this correctly? Job loss and financial stress is statistically shown to increase parental frustrations, resulting in abusing the children.

I am a tad concerned what the sentence- “the greatest improvement in a populations health care are likely to derive from social interventions.” – means.

I suspect it does NOT mean JOBS for unemployed parents.
