Michigan Adoptive Families File Federal Lawsuit

Cole et al v. Snyder

Today in a Michigan federal court, 14 adoptive parents filed a federal class action lawsuit against their Governor, Rick Snyder, and the Michigan Department of Health Services. The suit alleges that the state breached it's Adoptiove Medical Subsidy (AMS) which agrees to provide medically necessary services for post adoptive children with mental health and physical disabilities.

Parents have been forced to live in dangerous conditions due to severe mental health issues of their post adoptive children. Many of the kids have FASD, PTSD, and aggressive behaviors, which cannot be safely managed in a family setting. Families have been threatened by DCFS and placed into the same Catch 22 that we were. Pick the child up from the psychiatric hospital and face charges of child endangerment for failure to protect the other children or leave him at the hospital and face charges of child neglect and abandonment.

Illinois families are monitoring this important landmark case and are hoping they win.
