The New York State Appellate Division, First Department, affirmed yesterday a decision by New York County Family Court Judge, Clark V. Richardson, that gave custody of three children to their father after determining that the mother had attacked the father in front of the children.
In the Matter of Aliyah B., the court also stated that the preponderance of the evidence showed that there was educational neglect on the part of the mother, as one child had missed 64 out of 181 days of school and was late 38 ouft of 181 days.
The court also ruled that family court used proper discretion in issuing an order of protection against the mother, and that it was in the best interests of the children that the father had relocated with them to Pennsylvania where the father felt the children's lives would be improved by living with his sister.
